1995 WISCONSIN ACT 219
An Act relating to: amending various provisions of the statutes for the purpose of correcting errors (Revisor's Correction Bill).
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
219,1 Section 1 . 5.02 (23) of the statutes, as affected by 1995 Wisconsin Act 27, section 9145 (1) (c), is amended to read:
5.02 (23) “State office" means the offices of governor, lieutenant governor, secretary of state, state treasurer, attorney general, secretary of education state superintendent, justice of the supreme court, court of appeals judge, circuit court judge, state senator, state representative to the assembly and district attorney.
Note: Reinserts language unintentionally replaced by 1995 Wis. Act 27, section 9145 (1) (c). That section provides, with limited exceptions inapplicable to this provision, that all references in the statutes to “state superintendent of public instruction" are changed to “secretary of education". However: a) article X, section 1, of the constitution requires the election of the state superintendent; b) section 177m of 1995 Wis. Act 27, which creates the position of secretary of education, provides for filling that position by appointment; and c) the Budget Analysis states that the secretary of education is “nominated by the governor and appointed with the advice and consent of the senate".
219,2 Section 2 . 5.02 (24) of the statutes, as affected by 1995 Wisconsin Act 27, section 9145 (1) (c), is amended to read:
5.02 (24) “State superintendent" means the secretary of education state superintendent.
Note: See the Note to Section 1 of this bill.
219,3 Section 3 . 5.58 (2) (title) of the statutes, as affected by 1995 Wisconsin Act 1995 Wisconsin Act 27, section 9145 (1) (c), is amended to read:
5.58 (2) (title) Secretary of education State superintendent of public instruction; judiciary; county executive; and county supervisors.
Note: See the Note to Section 1 of this bill.
219,4 Section 4 . 5.58 (2) (a) of the statutes, as affected by 1995 Wisconsin Act 27, section 9145 (1) (c), is amended to read:
5.58 (2) (a) There shall be one separate ballot for state superintendent, judicial officers, county executive under s. 59.031 and county supervisor. In counties having a population of 500,000 or more, the ballot also shall include those offices under s. 8.11 (2) and (2m). The arrangement of names of candidates for state superintendent, justice, court of appeals judge and circuit court judge shall be determined by the board in the manner specified in s. 5.60 (1) (b). Arrangement of the names of candidates for county executive and county supervisor shall be determined by the county clerk or by the executive director of the county board of election commissioners in the manner specified in s. 5.60 (1) (b). The ballot shall be titled “Official Ballot for Secretary of Education State Superintendent of Public Instruction, Judicial, County Executive and County Supervisor Primary".
Note: See the Note to Section 1 of this bill.
219,5 Section 5. 11.26 (1) (a) of the statutes, as affected by 1995 Wisconsin Act 27, section 9145 (1) (c), is amended to read:
11.26 (1) (a) Candidates for governor, lieutenant governor, secretary of state, state treasurer, attorney general, secretary of education state superintendent or justice, $10,000.
