2001 WISCONSIN ACT 25
An Act relating to: national guard tuition grants, requiring the lapse of certain program revenue moneys to the general fund, and making an appropriation.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
25,1 Section 1. Nonstatutory provisions.
(1) Vacant positions in the executive branch of state government.
(a) In this subsection:
1. "Secretary" means the secretary of administration.
2. "State agency" means any office, department, or independent agency in the executive branch of government, other than the board of regents of the University of Wisconsin System.
(b) No later than 30 days after the effective date of this paragraph, the secretary shall determine for each state agency the number of FTE positions that are funded from program revenue and that have been vacant since the 1st day of the 9th month immediately preceding the effective date of this paragraph, other than any position authorized to perform duties in a state institution or facility that has not been completed or has not begun operations as of July 1, 2001. The secretary shall also determine the annual salary and fringe benefits costs for such positions and shall identify the program revenue appropriations from which these costs are paid during the 2001-02 fiscal year.
(c) 1. During the 2001-02 fiscal year, the secretary shall lapse to the general fund from program revenue appropriations identified in paragraph (b) an amount equivalent to $532,100. The secretary shall determine from which appropriations the amount shall be lapsed.
2. Each sum certain appropriation for the 2001-02 fiscal year from which an amount is lapsed under subdivision 1. is decreased by the amount of any lapse. Each continuing appropriation for the 2001-02 fiscal year from which an amount is lapsed under subdivision 1. is reestimated to subtract from such estimate the amount of any lapse.
(d) The secretary shall notify the joint committee on finance of all actions taken under paragraphs (b) and (c).
(2) Lapses from certain appropriations from which membership dues in state and national organizations are paid.
(a) In this subsection:
1. "Secretary" means the secretary of administration.
2. "State agency" has the meaning given in section 20.001 (1) of the statutes.
(b) The secretary shall determine for each state agency the amount expended by the state agency for membership dues for any state or national organization in the 2000-01 fiscal year that was funded from program revenue.
(c) The secretary shall, during the 2001-02 fiscal year, lapse to the general fund an amount equal to 20% of the total amount expended for membership dues for any state or national organization from the appropriations identified in paragraph (b). The secretary shall, during the 2002-03 fiscal year, lapse to the general fund from such program revenue appropriations an equivalent amount.
(d) 1. Each sum certain appropriation for the 2001-02 fiscal year from which an amount is lapsed under paragraph (c) in that year is decreased by the amount of any lapse. Each continuing appropriation for the 2001-02 fiscal year from which an amount is lapsed under paragraph (c) in that year is reestimated to subtract from such estimate the amount of any lapse.
2. Each sum certain appropriation for the 2002-03 fiscal year from which an amount is lapsed under paragraph (c) in that year is decreased by the amount of any lapse. Each continuing appropriation for the 2002-03 fiscal year from which an amount is lapsed under paragraph (c) in that year is reestimated to subtract from such estimate the amount of any lapse.
25,2 Section 2. Appropriation changes.
(1) National guard tuition grants. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of military affairs under section 20.465 (2) (a) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $1,534,300 for fiscal year 2001-02 for the purpose for which the appropriation is made.
