AB790,1,3 1An Act to renumber and amend 26.39 (4); and to create 26.39 (4) (b) of the
2statutes; relating to: funding related to forestry for the department of natural
3resources and making appropriations.
Analysis by the Legislative Reference Bureau
The 2001-03 budget bill enacted by the state legislature created a department
of forestry and transferred the division of forestry under the department of natural
resources (DNR) and all of its related programs, operations, and employee positions
to this new department. The effective date of the transfer was to be July 1, 2002.
The governor vetoed these provisions. The veto included the elimination of the
appropriations for the new department for fiscal year 2002-03. This bill increases
the corresponding appropriations made to DNR and the corresponding employee
positions under DNR that relate to this division and these programs and operations
for fiscal year 2002-03 to restore the funding to DNR for fiscal year 2002-03.
Under current law, DNR may sell planting stock for forest and woodlot
planting. Under current law, a purchaser of such planting stock must pay a two-cent
seedling surcharge for each seedling, which is in addition to the price of the seedling.
Beginning on July 1, 2002, the surcharge is raised to three cents. Under current law,
these moneys are used for the development of a forestry education curriculum for
grades kindergarten through 12 and for developing a program to educate the public
about the value of sustainable forestry, which is the management of forest
ecosystems so that they provide future benefits. The bill changes the allocation of
these moneys so that beginning with fiscal year 2002-03 50% of the moneys are

appropriated for a forestry education curriculum and 50% are appropriated for the
sustainable forestry program. Under current law, an amount totaling not more than
$300,000 is appropriated for the development of the school curriculum, with the
balance going to educating the public about sustainable forestry.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB790, s. 1 1Section 1. 26.39 (4) of the statutes, as created by 2001 Wisconsin Act 16, is
2renumbered 26.39 (4) (a) and amended to read:

4s. 20.370 (1) (cu) the moneys received as surcharges under s. 28.06 (2m) during fiscal
5year 2001-02
, up to a total amount of $300,000. The department shall credit any
6balance over $300,000 that remains from the moneys received as such surcharges
7during fiscal year 2001-02 to the appropriation account under s. 20.370 (1) (cv).
AB790, s. 2 8Section 2. 26.39 (4) (b) of the statutes is created to read:

19authorized FTE positions for the department of natural resources are increased by

12.0 FED positions related to the southern state forests on July 1, 2002, to be funded
2from the appropriation under section 20.370 (1) (my) of the statutes.
AB790,3,63 (3) General program operations; administrative services. The authorized
4FTE positions for the department of natural resources are increased by 1.48 PR
5positions related to forestry on July 1, 2002, to be funded from the appropriation
6under section 20.370 (8) (mk) of the statutes.
