AB790,1,3 An Act to renumber and amend 26.39 (4); and to create 26.39 (4) (b) of the statutes; relating to: funding related to forestry for the department of natural resources and making appropriations.

Analysis by the Legislative Reference Bureau

The 2001-03 budget bill enacted by the state legislature created a department of forestry and transferred the division of forestry under the department of natural resources (DNR) and all of its related programs, operations, and employee positions to this new department. The effective date of the transfer was to be July 1, 2002. The governor vetoed these provisions. The veto included the elimination of the appropriations for the new department for fiscal year 2002-03. This bill increases the corresponding appropriations made to DNR and the corresponding employee positions under DNR that relate to this division and these programs and operations for fiscal year 2002-03 to restore the funding to DNR for fiscal year 2002-03.

Under current law, DNR may sell planting stock for forest and woodlot planting. Under current law, a purchaser of such planting stock must pay a two-cent seedling surcharge for each seedling, which is in addition to the price of the seedling. Beginning on July 1, 2002, the surcharge is raised to three cents. Under current law, these moneys are used for the development of a forestry education curriculum for grades kindergarten through 12 and for developing a program to educate the public about the value of sustainable forestry, which is the management of forest ecosystems so that they provide future benefits. The bill changes the allocation of these moneys so that beginning with fiscal year 2002-03 50% of the moneys are appropriated for a forestry education curriculum and 50% are appropriated for the sustainable forestry program. Under current law, an amount totaling not more than $300,000 is appropriated for the development of the school curriculum, with the balance going to educating the public about sustainable forestry.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB790, s. 1 Section 1. 26.39 (4) of the statutes, as created by 2001 Wisconsin Act 16, is renumbered 26.39 (4) (a) and amended to read:

AB790,2,7 26.39 (4) (a) The department shall credit to the appropriation account under s. 20.370 (1) (cu) the moneys received as surcharges under s. 28.06 (2m) during fiscal year 2001-02, up to a total amount of $300,000. The department shall credit any balance over $300,000 that remains from the moneys received as such surcharges during fiscal year 2001-02 to the appropriation account under s. 20.370 (1) (cv).

AB790, s. 2 Section 2. 26.39 (4) (b) of the statutes is created to read:

AB790,2,12 26.39 (4) (b) For fiscal year 2002-03 and each fiscal year thereafter, the department shall credit 50% of the moneys received as surcharges under s. 28.06 (2m) during the applicable fiscal year to the appropriation account under s. 20.370 (1) (cu) and the remaining 50% to the appropriation account under s. 20.370 (1) (cv).

AB790, s. 3 Section 3. Nonstatutory provisions.

AB790,2,17 (1) General program operations; federal funds; forestry. The authorized FTE positions for the department of natural resources are increased by 3.5 FED positions related to forestry on July 1, 2002, to be funded from the appropriation under section 20.370 (1) (my) of the statutes.

AB790,3,2 (2) General program operations; federal funds; southern state forests. The authorized FTE positions for the department of natural resources are increased by 2.0 FED positions related to the southern state forests on July 1, 2002, to be funded from the appropriation under section 20.370 (1) (my) of the statutes.

AB790,3,6 (3) General program operations; administrative services. The authorized FTE positions for the department of natural resources are increased by 1.48 PR positions related to forestry on July 1, 2002, to be funded from the appropriation under section 20.370 (8) (mk) of the statutes.

AB790,3,9 (4) Required general fund balance. Section 20.003 (4) of the statutes and 2001 Wisconsin Act 16, section 9101 (25j), do not apply to the action of the legislature in enacting this act.

AB790, s. 4 Section 4. Appropriation changes.

AB790,3,15 (1) Forestry; reforestation. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (1) (cq) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $100,000 for fiscal year 2002-03 to increase funding for the purpose for which the appropriation is made.

AB790,3,20 (2) Forestry education curriculum. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (1) (cu) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $318,700 for fiscal year 2002-03 to increase funding for the purpose for which the appropriation is made.

In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (1) (cv) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $318,700 for fiscal year 2002-03 to increase funding for the purpose for which the appropriation is made.

AB790,4,6 (4) Forest lands; taxes and assessments. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (1) (kq) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $99,000 for fiscal year 2002-03 to increase funding for the payment of taxes and assessments that are or may become a lien on state forest lands.

AB790,4,13 (5) Forest lands; wildlife management. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (1) (Lt) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $153,400 for fiscal year 2002-03 to increase funding for the purpose for which the appropriation is made and to increase the authorized FTE positions for the department by 2.5 SEG positions related to wildlife management in forested areas.

AB790,4,18 (6) Forest lands; state snowmobile trails and areas. In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (3) (mu) of the statutes, as affected by the acts of 2001, the dollar amount is increased by $901,100 for fiscal year 2002-03 to increase funding for integrated science services related to forestry and to increase the authorized FTE positions for the department by 10.03 SEG positions related to integrated science services.

AB790,6,12 (13) Aids for wildlife and recreation on county forest lands.
