AB540,1,4 1An Act to amend 19.45 (11) (b); and to create 19.48 (17) and 36.11 (49) of the
2statutes; relating to: the code of ethics governing unclassified personnel of the
3University of Wisconsin System and requiring the exercise of the rule-making
4authority.
Analysis by the Legislative Reference Bureau
Currently, the Board of Regents of the University of Wisconsin System must
establish a code of ethics for unclassified personnel of the system whose positions are
not subject to the statutory code of ethics for state public officials and employees.
This bill specifically requires this code to be promulgated by rule and also
requires that the rules relating to the code of ethics include a requirement for each
individual who is a member of the faculty to annually report to the system income
received from any source other than the University of Wisconsin System resulting
from any pursuit that is related to the professional responsibilities or expertise of the
individual as a member of the faculty, including income from the patents, royalties,
honorariums, consulting services, and grants, whether derived from foreign or
domestic sources. The bill directs the Board of Regents to promptly post on the
Internet all reports received from members of the faculty in accordance with the
rules promulgated by the board. The bill also directs the state Ethics Board to
maintain or participate in a site on the Internet from which access to the text of the
rules of the Board of Regents relating to the code of ethics is provided.
In addition, the bill provides that if the Board of Regents fails to post on the
Internet the information received from the reports required by the bill by January

1, 2006, the Ethics Board must post the information on the Internet. The bill directs
the Ethics Board to charge to the Board of Regents all reasonable costs incurred by
the Ethics Board in posting the information.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB540, s. 1 1Section 1. 19.45 (11) (b) of the statutes is amended to read:
AB540,2,102 19.45 (11) (b) The board of regents of the University of Wisconsin System shall,
3by rule,
establish a code of ethics for unclassified personnel in that system who are
4not subject to this subchapter. The rules shall include a requirement for each
5individual who is a member of the faculty, as defined in s. 36.05 (8), to annually report
6to the system income received from from any source other than the University of
7Wisconsin System resulting from any pursuit that is related to the professional
8responsibilities or expertise of the individual as a member of the faculty, including
9income from the patents, royalties, honorariums, consulting services, and grants,
10whether derived from foreign or domestic sources.
AB540, s. 2 11Section 2. 19.48 (17) of the statutes is created to read:
AB540,2,1412 19.48 (17) Maintain or participate in a site on the Internet from which the
13board shall enable access to the text of rules adopted by the Board of Regents of the
14University of Wisconsin System under s. 19.45 (11) (b).
AB540, s. 3 15Section 3. 36.11 (49) of the statutes is created to read:
AB540,2,1816 36.11 (49) Reports by faculty on certain outside income. The board shall
17promptly post on the Internet all reports received from members of the faculty in
18accordance with rules promulgated under s. 19.45 (11) (b).
AB540, s. 4 19Section 4. Nonstatutory provisions.

1(1) If the Board of Regents of the University of Wisconsin System fails to post
2on the Internet the information received under section 36.11 (49) of the statutes, as
3created by this act, by January 1, 2006, the ethics board shall post on the Internet
4the information received under that subsection. The ethics board may contract for
5the services required to effect the posting and section 16.705 of the statutes does not
6apply to any contract entered into by the ethics board for that purpose. The ethics
7board shall transmit to the department of administration a statement of all costs
8incurred by the board in posting on the Internet the information received under
9section 36.11 (49) of the statutes, as created by this act. The department of
10administration shall audit the statement and transfer to the appropriation account
11under section 20.521 (1) (a) of the statutes from the appropriation account under
12section 20.285 (1) (a) of the statutes an amount equal to all expenses reasonably
13incurred by the ethics board in posting the information required under section 36.11
14(49) of the statutes, as created by this act. The amounts in the schedule under section
1520.521 (1) (a) of the statutes are increased by the amount so transferred for the fiscal
16year in which the transfer is made.

AB540,3,1918 (1) The treatment of section 19.45 (11) (b) of the statutes first applies with
19respect to the year that includes the effective date of this subsection.
