AB788,1,2 1An Act to amend 29.011 (2) of the statutes; relating to: the legal title to wild
2animals illegally killed or possessed.

Under current law, the legal title to a wild animal or carcass taken or possessed
in violation of the provisions regarding hunting, fishing, or trapping remains with
the state. The legal title to a wild animal or carcass legally taken or possessed
belongs to the person who has the wild animal or carcass unless he or she later
violates a provision related to the possession, use, sale, or transportation of the wild
animal or carcass.
This bill adds that the legal title to a wild animal or carcass remains with the
state if the wild animal or carcass is taken while violating the provisions regulating
the use and transportation of firearms and bows or while trespassing on land.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB788, s. 1 3Section 1. 29.011 (2) of the statutes is amended to read:
AB788,2,44 29.011 (2) The legal title to a wild animal or carcass, taken or reduced to
5possession in violation of this chapter, or while violating s. 167.31 or 943.13, remains

1in the state. The title to a wild animal or carcass, lawfully acquired, is subject to the
2condition that upon the violation of this chapter relating to the possession, use,
3giving, sale, barter or transportation of a wild animal or carcass by the owner, the
4ownership shall revert, as a result of the violation, to the state.
