2011 Senate Resolution 7
ENGROSSED RESOLUTION
Relating to: imposing penalties and costs on Senator Jon Erpenbach for being absent without leave.
Whereas, Senator Jon Erpenbach of the 27th Senate District has been absent without leave from March 3, 2011, and March 8, 2011, session days; and
Whereas, Senate Rule 13n imposes penalties and costs on any member of the senate who is absent without leave for two or more session days; and
Whereas, pursuant to Senate Rule 13n, Senator Erpenbach has received notice by publication of both this resolution and the senate calendar which includes consideration of this resolution that he is subject to such penalties and costs; and
Whereas, the sergeant at arms has delivered a copy of both this resolution and the senate calendar which includes consideration of this resolution to Senator Erpenbach's senate office, thereby providing additional notice to the senator, pursuant to Senate Rule 13n; and
Whereas, pursuant to Senate Rule 13n, Senator Erpenbach has an opportunity to be heard, on the session day on which this resolution is before the senate, on the matter of whether or not penalties and costs for being absent without leave may be imposed on the senator; and
Whereas, upon adoption of this resolution, Senator Erpenbach is responsible for the penalties and costs imposed under Senate Rule 13n for each day that the senator is absent without leave; now, therefore, be it
Resolved by the
senate, That pursuant to Senate Rule 13n, Senator Jon Erpenbach shall pay the penalties and costs imposed under Senate Rule 13n for being absent without leave for two or more session days and that the total amount of such penalties and costs shall be calculated by the senate chief clerk and submitted to the president who shall deliver that total, in writing, to Senator Jon Erpenbach's senate office for immediate payment.
