AB318,1,3 1An Act to repeal 108.02 (26m) and 108.04 (3); and to amend 108.04 (11) (bm)
2of the statutes; relating to: deletion of the waiting period for collection of
3unemployment insurance benefits.
Analysis by the Legislative Reference Bureau
Currently, a claimant must wait one week after becoming eligible to receive
unemployment insurance (UI) benefits before the claimant may receive benefits for
a week of unemployment. The waiting period does not affect the maximum number
of weeks of a claimant's benefit eligibility.
This bill deletes the one-week waiting period, thus permitting a claimant to
receive UI benefits beginning with his or her first week of eligibility.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB318,1 4Section 1. 108.02 (26m) of the statutes is repealed.
AB318,2 5Section 2. 108.04 (3) of the statutes is repealed.
AB318,3 6Section 3. 108.04 (11) (bm) of the statutes is amended to read:

1108.04 (11) (bm) The department shall apply any ineligibility under par. (be)
2against benefits and weeks of eligibility for which the claimant would otherwise be
3eligible after the week of concealment and within 6 years after the date of an initial
4determination issued under s. 108.09 finding that a concealment occurred. The
5claimant shall not receive waiting period credit under s. 108.04 (3) for the period of
6ineligibility applied under par. (be).
If no benefit rate applies to the week for which
7the claim is made, the department shall use the claimant's benefit rate for the
8claimant's next benefit year beginning after the week of concealment to determine
9the amount of the benefit reduction.
AB318,4 10Section 4. Initial applicability.
AB318,2,1211 (1) This act first applies to benefit years beginning on the effective date of this
12subsection.
