AB740,1,6 An Act to amend 20.292 (1) (a), 20.292 (1) (am), 20.292 (1) (d), 20.292 (1) (f), 20.292 (1) (g), 20.292 (1) (ga), 20.292 (1) (h), 20.292 (1) (i), 20.292 (1) (k), 20.292 (1) (L), 20.292 (1) (q), 38.28 (2) (b) (intro.), 38.28 (2) (be) 1. (intro.) and 38.28 (2) (bm) 1.; and to create 20.235 (1) (fr), 20.235 (1) (j), 20.235 (1) (kr) and 38.04 (7r) of the statutes; relating to: Wisconsin grants for technical college students and making appropriations.

Analysis by the Legislative Reference Bureau

This bill provides for additional funding for Wisconsin grants to technical college students. Under current law, the Higher Educational Aids Board (HEAB) administers the Wisconsin grants program, which provides grants to resident postsecondary students enrolled in institutions of higher education, including technical colleges. The bill provides additional funding for Wisconsin grants to technical college students by allowing the Technical College System Board (TCSB) to solicit contributions from technical college district boards to HEAB to provide funding for the grants. In addition, the bill allows the TCSB to transfer money from certain of its appropriations for the grants. The bill limits the total amount the TCSB may transfer in a fiscal year based on the amount of contributions by district boards in the fiscal year. Under that limit, the amount of contributions is subtracted from $1,000,000, and the transfers may not exceed the difference.

The bill also provides additional general purpose revenue (GPR) for the grants to technical college students, but only if the TCSB makes transfers or district boards make contributions in a fiscal year. The bill provides GPR in a fiscal year in an amount equal to the sum of the transfers and contributions in the fiscal year, except that the GPR may not exceed $1,000,000.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB740,1 Section 1. 20.235 (1) (fr) of the statutes is created to read:

AB740,2,6 20.235 (1) (fr) Wisconsin grants; technical college students; sum sufficient match. A sum sufficient equal to the amounts appropriated under pars. (kr) and (j) in a fiscal year for the Wisconsin grant program under s. 39.435 for technical college students, except for grants awarded under s. 39.435 (2) or (5). The amount appropriated under this paragraph in a fiscal year may not exceed $1,000,000.

AB740,2 Section 2. 20.235 (1) (j) of the statutes is created to read:

AB740,2,11 20.235 (1) (j) Wisconsin grants; technical college students; program revenue. All moneys received from technical college district boards under s. 38.04 (7r) (b) for the Wisconsin grant program under s. 39.435 for technical college students, except for grants awarded under s. 39.435 (2) or (5).

AB740,3 Section 3. 20.235 (1) (kr) of the statutes is created to read:

AB740,2,17 20.235 (1) (kr) Wisconsin grants; technical college students; program revenue-service. All moneys transferred from the appropriation accounts under ss. 20.292 (1) (a) to (d), (f) to (ga), (h), (i), (k), (L), and (q) for the Wisconsin grant program under s. 39.435 for technical college students, except for grants awarded under s. 39.435 (2) or (5).

AB740,4 Section 4. 20.292 (1) (a) of the statutes is amended to read:

AB740,3,6 20.292 (1) (a) General program operations. The amounts in the schedule for general program operations and for transfers under s. 38.04 (7r) (a). In case any allotment under this paragraph is made to a state university or any other wholly state-controlled educational institution, the program appropriations for the operation of such school or institution for the year in which such allotment was made shall be reduced by an amount equal to the amount of such allotment.

AB740,5 Section 5. 20.292 (1) (am) of the statutes is amended to read:

AB740,3,9 20.292 (1) (am) Fee remissions. The amounts in the schedule for the fee remissions under s. 38.24 (5) and for transfers under s. 38.04 (7r) (a).

AB740,6 Section 6. 20.292 (1) (d) of the statutes is amended to read:

AB740,3,22 20.292 (1) (d) State aid for technical colleges; statewide guide. The amounts in the schedule for state aids for technical college districts and technical colleges, including area schools and programs established and maintained under the supervision of the board, under s. 38.28 (2) (b), (be), and (bm), and for production and distribution of the statewide guide under s. 38.04 (18), and for transfers under s. 38.04 (7r) (a). Of the amount in the schedule for each fiscal year not exceeding $50,000 may be spent by the board to match federal funds made available for technical education by any act of congress for the purposes set forth in such act and no more than $125,000 may be spent by the board to produce and distribute the statewide guide under s. 38.04 (18). If, in any fiscal year, actual program fees raised under s. 38.24 (1m) exceed board estimates, the increase shall be used to offset actual district aidable cost.

AB740,7 Section 7. 20.292 (1) (f) of the statutes is amended to read:

AB740,4,2 20.292 (1) (f) Grants to district boards. As a continuing appropriation, the amounts in the schedule for aids and grants to technical college districts under ss. 38.04 (13) (a), (20), (28), and (32) (a), 38.26, 38.27, 38.272, 38.28 (4), 38.29, 38.32, 38.33, 38.38, 38.40 (4m), and 38.41 and for transfers under s. 38.04 (7r) (a).

AB740,8 Section 8. 20.292 (1) (g) of the statutes is amended to read:

AB740,4,7 20.292 (1) (g) Text materials. The amounts in the schedule for the preparation, publication and distribution of text material and for transfers under s. 38.04 (7r) (a). All moneys received from technical college district boards shall be credited to this appropriation.

AB740,9 Section 9. 20.292 (1) (ga) of the statutes is amended to read:

AB740,4,11 20.292 (1) (ga) Auxiliary services. All moneys received from fees collected under s. 38.40 (4r), for the delivery of services under s. 38.40 (4r) and for transfers under s. 38.04 (7r) (a).

AB740,10 Section 10. 20.292 (1) (h) of the statutes is amended to read:

AB740,4,15 20.292 (1) (h) Gifts and grants. All moneys received from gifts, grants, bequests and devises to be used in the execution of the technical college program and for transfers under s. 38.04 (7r) (a).

AB740,11 Section 11. 20.292 (1) (i) of the statutes is amended to read:

AB740,4,18 20.292 (1) (i) Conferences. All moneys received from the conduct of conferences for the conduct of conferences and for transfers under s. 38.04 (7r) (a).

AB740,12 Section 12. 20.292 (1) (k) of the statutes is amended to read:

AB740,4,22 20.292 (1) (k) Gifts and grants. All moneys received from gifts and grants to be paid to individuals or to nongovernmental organizations and for transfers under s. 38.04 (7r) (a).

AB740,13 Section 13. 20.292 (1) (L) of the statutes is amended to read:

AB740,5,3 20.292 (1) (L) Services for district boards. The amounts in the schedule for services provided to technical college district boards and for transfers under s. 38.04 (7r) (a). All moneys received from technical college district boards or other persons for services provided to the district boards to pay for the cost of such services shall be credited to this appropriation.

AB740,14 Section 14. 20.292 (1) (q) of the statutes is amended to read:

AB740,5,7 20.292 (1) (q) Agricultural education consultant. The amounts in the schedule for an agricultural education consultant at the technical college system board and for transfers under s. 38.04 (7r) (a).

AB740,15 Section 15. 38.04 (7r) of the statutes is created to read:

AB740,5,13 38.04 (7r) Wisconsin grants supplemental funding. (a) The board may transfer funds from the appropriation accounts under s. 20.292 (1) (a) to (d), (f) to (ga), (h), (i), (k), (L), and (q) to the appropriation account under s. 20.325 (1) (kr). The total amount transferred under this paragraph in a fiscal year may not exceed an amount equal to $1,000,000 less the amount received under par. (b) in the fiscal year.

AB740,5,18 (b) The board may solicit contributions from district boards to provide funding to the higher educational aids board for the Wisconsin grant program under s. 39.435 for technical college students, except for grants awarded under s. 39.435 (2) or (5). All moneys received from district boards under this paragraph shall be deposited in the general fund and credited to the appropriation account under s. 20.235 (1) (j).

AB740,16 Section 16. 38.28 (2) (b) (intro.) of the statutes is amended to read:

AB740,5,22 38.28 (2) (b) (intro.) Subject to par. (bm) and any transfers under s. 38.04 (7r) (a), each district's share of the amount appropriated under s. 20.292 (1) (d) shall be computed as follows:

AB740,6,3 38.28 (2) (be) 1. (intro.) Subject to subd. 1m. and par. (bm) and any transfers under s. 38.04 (7r) (a), the board shall establish a formula for allocating the amount appropriated under s. 20.292 (1) (d) in a fiscal year to each district based on a district's performance in the 3 previous fiscal years with respect to the following criteria:
