2017 WISCONSIN ACT 300
An Act to repeal 115.435 (3); to renumber and amend 115.435 (1); to amend 115.435 (2); and to create 115.435 (1g) of the statutes; relating to: supplemental aid for school districts with a large area.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
300,1 Section 1. 115.435 (1) of the statutes is renumbered 115.435 (1r), and 115.435 (1r) (a), (b) and (c), as renumbered, are amended to read:
115.435 (1r) (a) The school district had an enrollment district's membership in the previous school year of fewer was no more than 500 pupils.
(b) The school district is at least 200 square miles in area. The clerks of the municipalities within which the school district is located shall verify the school district's area on a form prepared by the department.
(c) At least 80 percent of the real property in the school district is exempt from taxation under s. 70.11, taxed as forest croplands under subch. I of ch. 77, owned by or held in trust for a federally recognized American Indian tribe, or owned by the federal government. The clerks of the municipalities within which the school district is located shall verify the information required under this paragraph on a form prepared by the department.
300,2 Section 2. 115.435 (1g) of the statutes is created to read:
115.435 (1g) In this section, “membership" has the meaning given in s. 121.004 (5).
300,3 Section 3. 115.435 (2) of the statutes is amended to read:
115.435 (2) No later than June 30 of the current school year, the department shall, from the appropriation under s. 20.255 (2) (ad), pay each school district that satisfies the criteria under sub. (1) (1r) $350 for each pupil enrolled in multiplied by the school district membership in the previous school year. If the appropriation under s. 20.255 (2) (ad) is insufficient to pay the full amount under this subsection, the funds shall be prorated among the entitled school districts.
300,4 Section 4. 115.435 (3) of the statutes is repealed.
300,5 Section 5. Chapter PI 10 of the administrative code is repealed.
