SB9,1,2 1An Act to create 49.45 (60) of the statutes; relating to: creation of a savings
2account program in the Medical Assistance program.
Analysis by the Legislative Reference Bureau
The bill requires the Department of Health Services to submit a waiver request
to the federal government to establish and implement a savings account program in
the Medical Assistance program. The savings account program should be similar in
function and operation to Health Savings Accounts, known as HSAs, which are
accounts under federal law that are used to pay or reimburse certain medical
expenses. DHS must exclude from any requirement to have a savings account any
individual who is elderly, blind, or disabled or who is a child.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB9,1 3Section 1. 49.45 (60) of the statutes is created to read:
SB9,2,54 49.45 (60) Savings account program. The department shall submit to the
5federal department of health and human services a request for a waiver of federal
6Medicaid law to establish and implement a savings account program that is similar

1in function and operation to health savings accounts, created in federal P.L. 108-173,
2in the Medical Assistance program under this subchapter. The department shall
3exclude from any requirement to have a Medical Assistance savings account under
4the waiver request under this subsection any individual who is elderly, blind, or
5disabled and any child.
