SB82,1,4 1An Act to renumber 947.015; to amend 938.34 (14q) and 973.137 (1m); and to
2create
947.015 (title) and 947.015 (2) of the statutes; relating to: threat to use
3a firearm on school property to injure or kill a person and providing a criminal
4penalty.
Analysis by the Legislative Reference Bureau
This bill creates a crime for intentionally conveying any threat or false
information concerning an attempt to use a firearm to injure or kill a person on school
property, on transportation provided by a school, or at an event sanctioned by a
school. A person who is convicted of the crime is guilty of a Class I felony.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB82,1 5Section 1. 938.34 (14q) of the statutes is amended to read:
SB82,2,86 938.34 (14q) Certain bomb scares and firearm violations. In addition to any
7other disposition imposed under this section, if the juvenile is found to have violated
8s. 947.015 (1) and the property involved is owned or leased by the state or any

1political subdivision of the state, or if the property involved is a school premises, as
2defined in s. 948.61 (1) (c), or if the juvenile is found to have violated s. 941.235,
3947.015 (2),
or 948.605, immediately suspend the juvenile's operating privilege, as
4defined in s. 340.01 (40), for 2 years. The court shall immediately forward to the
5department of transportation the notice of suspension, stating that the suspension
6is for a violation of s. 947.015 (1) involving school premises, or for a violation of s.
7941.235, 947.015 (2), or 948.605. If otherwise eligible, the juvenile is eligible for an
8occupational license under s. 343.10.
SB82,2 9Section 2. 947.015 (title) of the statutes is created to read:
SB82,2,10 10947.015 (title) Threats to destroy property or use a firearm.
SB82,3 11Section 3. 947.015 of the statutes is renumbered 947.015 (1).
SB82,4 12Section 4. 947.015 (2) of the statutes is created to read:
SB82,2,1813 947.015 (2) Threat to use firearm on school premises. Whoever intentionally
14conveys or causes to be conveyed any threat or false information, knowing such to
15be false, concerning an attempt or alleged attempt being made or to be made to use
16a firearm to injure or kill another individual on property owned or leased by a school
17or school district, on transportation provided by a school or school district, or at an
18event sanctioned by a school or school district is guilty of a Class I felony.
SB82,5 19Section 5. 973.137 (1m) of the statutes is amended to read:
SB82,2,2220 973.137 (1m) A violation of s. 947.015 (1), if the property involved is owned or
21leased by the state or any political subdivision of the state, or if the property involved
22is a school premises, as defined in s. 948.61 (1) (c), or a violation of s. 947.015 (2).
