SB179,1,2 1An Act to create 98.09 of the statutes; relating to: displaying gas taxes on gas
2pumps.
Analysis by the Legislative Reference Bureau
This bill requires a state or municipal weights and measures inspector or sealer,
when inspecting a gas pump, to place a sticker on the pump that shows the federal
and state gas tax rates per gallon of gas. The bill requires the Department of
Agriculture, Trade and Consumer Protection to develop a sticker for this purpose and
to distribute stickers to all state and municipal weights and measures inspectors and
sealers who inspect gas pumps. DATCP is also required to update and redistribute
the stickers when the federal or state gas tax rate changes.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB179,1 3Section 1. 98.09 of the statutes is created to read:
SB179,2,5 498.09 Motor vehicle fuel pump sticker. (1) The department shall produce
5a sticker, for display on each motor vehicle fuel pump from which motor vehicle fuel
6is dispensed for sale at retail in this state, that shows the federal motor vehicle fuel

1tax rate and the state motor vehicle fuel tax rate, in cents per gallon, for gasoline and
2for diesel fuel. The sticker shall be at least 3.5 inches on each side. The department
3shall distribute the sticker to all inspectors and sealers who inspect or seal motor
4vehicle fuel pumps in this state. The department shall produce and distribute a new
5sticker each time the federal or state motor vehicle fuel tax rate changes.
SB179,2,10 6(2) Inspectors and sealers who inspect or seal motor vehicle fuel pumps shall,
7at the time of inspecting or sealing a motor vehicle fuel pump, place the sticker
8produced under sub. (1) on the pump being inspected or sealed. Inspectors and
9sealers shall display the sticker on the face of the pump so that it is clear,
10conspicuous, and prominent to consumers.
SB179,2,13 11(3) An owner or operator of a motor vehicle fuel pump from which motor vehicle
12fuel is dispensed for sale at retail is not liable for affixing or maintaining a sticker
13under this section.
SB179,2 14Section 2. Effective date.
SB179,2,1515 (1) This act takes effect on July 1, 2020.
