Proposed Rule to Amend
Wis. Admin. Code, Ch. UWS 17
A.   Economic Impact Analysis
  In accordance with Wis. Stat. §227.137, the Board of Regents of the University of Wisconsin System has conducted an analysis in regard to what, if any, economic impact, the proposed rule will have and determines as follows:
  1.   The policy problem that the proposed rule is intended to address involves compliance with federal law and guidance. Specifically, certain provisions of the Wisconsin Administrative Code, Ch. UWS 17, do not conform to the procedural requirements issued by the U.S. Department of Education, Office for Civil Rights in its legal interpretation of Title IX of the Education Amendments of 1972, or the Violence Against Women Reauthorization Act of 2013 (“VAWA”). The proposed rule resolves this conflict by modifying certain procedural aspects of the disciplinary process to be consistent with federal law and guidance. This approach is consistent with the states of Illinois, Iowa, Michigan and Minnesota. It is also consistent with the guidance issued by the U.S. Department of Education, Office for Civil Rights, the federal agency responsible for enforcing the provisions of Title IX as it relates to higher education institutions that are subject to Title IX.  
  2.   The proposed rule will have minimal to no economic impact on businesses, business sectors, public utility ratepayers, local governmental units, and the state’s economy as a whole, which may be affected by the proposed rule.  
  3   The proposed rule will be highly effective in conforming the U.S. Department of Education, Office for Civil Rights’ legal interpretation of Title IX of the Education Amendments of 1972, and the Violence Against Women Reauthorization Act of 2013 (“VAWA”).
  4.   If the proposed rule is not promulgated, the existing rule will not conform to the U.S. Department of Education, Office for Civil Rights’ legal interpretation of Title IX of the Education Amendments of 1972, or the Violence Against Women Reauthorization Act of 2013 (“VAWA”).
  5.   The proposed rule will not adversely affect in a material way the economy, a sector of the economy, productivity, jobs, or the overall economic competitiveness of the State of Wisconsin.
  6.   The proposed rule will have no economic effect on public utilities or their ratepayers.
  7.   The proposed rule does not relate to a rule of the Department of Safety and Professional Services establishing standards for dwelling construction.
B.   Fiscal Estimate
  In accordance with Wis. Stat. §227.14(4), the Board of Regents of the University of Wisconsin System hereby determines that:
1.   The proposed rule will have minimal to no fiscal impact on county, city, village, town, school district, technical college district and sewerage district fiscal liabilities and revenues.
2.   There is no anticipated state fiscal effect during the current biennium and minimal to no fiscal impact on annual state funds.
3.   There will be no significant fiscal effect on the private sector.
  This report is hereby submitted in accordance with the Executive Order #50 Relating to Guidelines for the Promulgation of Administrative Rules, Wis. Stat. §§227.137 and 227.14.
