NOTICE OF SUBMITTAL OF PROPOSED RULE
TO LEGISLATIVE COUNCIL RULES CLEARINGHOUSE
NOTICE IS HEREBY GIVEN that on September 25, 2018, the Department of Justice (DOJ) submitted a proposed rule to the Wisconsin Legislative Council Clearinghouse pursuant to s. 227.15(1), Wis. Stats.
ANALYSIS
The proposed rule creates Chapter Jus 19, relating to standards and procedures for the frequent sobriety testing pilot program.
A related emergency rule, EmR 1805, creating the same code provision, has been published and is in effect.
STATEMENT OF SCOPE
The statement of scope for this rule, SS 072-18, was approved by the Governor on June 20, 2018, published in Register No. 750B, on June 25, 2018, and approved by Attorney General Brad D. Schimel on July 11, 2018.
AGENCY PROCEDURE FOR PROMULGATION
Pursuant to s. 227.16(2)(e), Stats., a public hearing is not required. The proposed rule will be promulgated without public hearing unless a petition is received by DOJ within 30 days after publication of the notice, signed by any of the following:
(a)   25 natural persons who will be affected by the rule.
(b)   A municipality that will be affected by the rule.
(c)   An association that is representation of a farm, labor, business, or professional group that will be affected by the rule.
