NOTICE OF HEARING
The Wisconsin Department of Agriculture, Trade and Consumer Protection (Department) announces that it will hold public hearings on the proposed permanent rule relating to ATCP 77 Laboratory Certification. The Department will hold three public hearings at the times and places shown below.
Hearing Dates and Locations:
The hearings will be held concurrently and testimony or comments will be taken on a first-come, first-served basis after the opening statements are read into the record at the hearings. There will be three hearings throughout the state, and the venues are listed below. Written comments will be accepted until July 15, 2019.

Following the public hearings, the hearing record will remain open until July 15, 2019, for additional public comments. Initial Regulatory Flexibility Analysis
This rule revision will update the following: 1) references, standards and test procedures for ensuring the reliability of certified laboratory testing; 2) certification fees to adequately cover costs, as required under Wis. Stat. § 93.12 (7); 3) the structure for prorating partial-year certification fees in accordance with Wis. Stat. § 93.12 (4); and 4) the frequency of on-site certified wastewater-testing laboratory reviews that optimize efficiency without jeopardizing public safety.
