2007 WISCONSIN ACT 99
An Act relating to: amending and revising various provisions of the statutes for the purpose of correcting errors, supplying omissions, and correcting and clarifying references (Revisor's Correction Bill).
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
99,1 Section 1. 250.042 (4) (a) 4. of the statutes, as created by 2005 Wisconsin Act 96, is amended to read:
250.042 (4) (a) 4. "Pupil services provider" means an individual who, at any time within 10 years before a state of emergency is declared under s. 166.03 (1) (b) 1. or 166.23, has been licensed as a school counselor, school psychologist, or school social worker under ch. PI 3, 2004 Wis. Adm. Code, or s. PI 34.31, Wis. Adm. Code rules promulgated by the department of public instruction.
Note: There is no 2004 Wisconsin Administrative Code. The code is a loose-leaf service and codes can be printed or reprinted during any month. There is no cumulative compilation of the code. This provision clarifies that s. 250.042 (4) (a) 4. applies to all school counselors, school psychologists, and school social workers licensed by the department of public instruction whether under s. PI 34.31 Wis. Adm. Code, the current licensing provision, created eff. 5-1-2000, or any applicable version of ch. PI 3 Wis. Adm. Code, the prior licensing provision, repealed eff. 7-1-2004.
99,2 Section 2. 250.042 (4) (a) 5. of the statutes, as created by 2005 Wisconsin Act 96, is amended to read:
250.042 (4) (a) 5. "Substance abuse prevention provider" means an individual who, at any time within 10 years before a state of emergency is declared under s. 166.03 (1) (b) 1. or 166.23, has been certified as a counselor, supervisor, or specialist described under s. HFS 75.02 (11) and (84), 2005 Wis. Adm. Code, in effect on January 20, 2006, or has been certified as a substance abuse counselor, clinical supervisor, or prevention specialist under s. 440.75 440.88.

This provision clarifies that the version of the code referred to is the version of the code in effect on January 20, 2006, which is the general effective date of 2005 Wis. Act 96. Section 440.75, as created by 2005 Wis. Act 25, was renumbered 440.88 by 2005 Wis. Act 254. "Described" is added for parallel construction and consistency with s. 440.88 (3), as renumbered.
99,3 Section 3. 250.042 (4) (c) 10. of the statutes, as created by 2005 Wisconsin Act 96, is amended to read:
250.042 (4) (c) 10. A school counselor, school psychologist, or school social worker whose license has been denied or revoked under ch. PI 3, 2004 Wis. Adm. Code, or s. PI 34.31, Wis. Adm. Code rules promulgated by the department of public instruction.

99,4 Section 4. 250.042 (4) (c) 11. of the statutes, as created by 2005 Wisconsin Act 96, is amended to read:
250.042 (4) (c) 11. A counselor, supervisor, or specialist whose certification has been denied or revoked by the Wisconsin Certification Board, Inc., or a substance abuse counselor, clinical supervisor, or prevention specialist whose certification has been revoked, limited, suspended, or denied under s. 440.75 440.88 (6).
Note: Section 440.75, as created by 2005 Wis. Act 25, was renumbered 440.88 by 2005 Wis. Act 254.
99,5 Section 5 . 440.88 (3) (a) (intro.) of the statutes, as affected by 2005 Wisconsin Act 254, is amended to read:
440.88 (3) (a) (intro.) Subject to pars. (b) and (c) and except as provided in sub. (3m), the department shall promulgate rules that establish minimum standards and qualifications for the certification of all of the following, including substance abuse counselors and clinical supervisors described under s. HFS 75.02 (11) and (84), 2005 Wis. Adm. Code, in effect on December 15, 2006:
