NR 679.54(3)(b) (b) The entire containment system, including walls and floor, shall be sufficiently impervious to used oil to prevent any used oil released into the containment system from migrating out of the system to the soil, groundwater or surface water.
NR 679.54(4) (4) Secondary containment for existing above ground tanks. Existing above ground tanks used to store or process used oil at processing and re-refining facilities shall be equipped with a secondary containment system.
NR 679.54(4)(a) (a) The secondary containment system shall consist of, at a minimum, the following in subds. 1. and 2., or subd. 3.:
NR 679.54(4)(a)1. 1. Dikes, berms or retaining walls.
NR 679.54(4)(a)2. 2. A floor. The floor shall cover the entire area within the dike, berm or retaining wall except areas where existing portions of the tank meet the ground.
NR 679.54(4)(a)3. 3. An equivalent secondary containment system.

NR 679.54(6)(b) (b) Fill pipes used to transfer used oil into underground storage tanks at processing and re-refining facilities shall be labeled or marked clearly with the words “Used Oil".
NR 679.54(7) (7) Response to releases. Upon detection of a release of used oil to the environment, an owner or operator shall perform all of the following cleanup steps:
NR 679.54(7)(a) (a) Stop the release.
NR 679.54(7)(b) (b) Contain the released used oil.
NR 679.54(7)(c) (c) Clean up and properly manage the released used oil and other materials.
NR 679.54(7)(d) (d) If necessary, repair or replace any leaking used oil storage containers or tanks prior to returning them to service.
NR 679.54(8) (8) Closure.
NR 679.54(8)(a)(a) Above ground tanks. Owners and operators who store or process used oil in above ground tanks shall comply with all of the following requirements:
NR 679.54(8)(a)1. 1. At closure of a tank system, the owner or operator shall remove or decontaminate used oil residues in tanks, contaminated containment system components, contaminated soils, and structures and equipment contaminated with used oil, and manage them as hazardous waste, unless the materials are not hazardous waste under ch. NR 661.
NR 679.54(8)(a)2. 2. If the owner or operator demonstrates that not all contaminated soils can be practicably removed or decontaminated as required in subd. 1., then the owner or operator shall close the tank system and perform long-term care according to the closure and long-term care requirements that apply to hazardous waste landfills (s. NR 665.0310).
NR 679.54(8)(b) (b) Containers. Owners and operators who store used oil in containers shall comply with all of the following requirements:

NR 679.55 NR 679.55Analysis plan. Owners or operators of used oil processing and re-refining facilities shall develop and follow a written analysis plan describing the procedures that will be used to comply with the analysis requirements of s. NR 679.53 and, if applicable, s. NR 679.72. The owner or operator shall keep the plan at the facility.
NR 679.55(1) (1) Rebuttable presumption for used oil in s. NR 679.53. At a minimum, the plan shall specify all of the following:
NR 679.55(1)(a) (a) Whether sample analyses or knowledge of the halogen content of the used oil will be used to make this determination.
NR 679.55(1)(b) (b) If sample analyses are used to make this determination, all of the following:
NR 679.55(1)(b)1. 1. The sampling method used to obtain representative samples to be analyzed. A representative sample may be obtained using one of the following:
NR 679.55(1)(b)1.a. a. One of the sampling methods in ch. NR 661 Appendix I.
NR 679.55(1)(b)1.b. b. A method shown to be equivalent under ss. NR 660.20 and 660.21.
NR 679.55(1)(b)2. 2. The frequency of sampling to be performed, and whether the analysis will be performed on-site or off-site.
NR 679.55(1)(b)3. 3. The methods used to analyze used oil for the parameters specified in s. NR 679.53.
NR 679.55(1)(c) (c) The type of information that will be used to determine the halogen content of the used oil.
NR 679.55(2) (2) On-specification used oil fuel in s. NR 679.72. At a minimum, the plan shall specify all of the following if s. NR 679.72 is applicable:

NR 679.56(1)(1)Acceptance. Used oil processors or re-refiners shall keep a record of each used oil shipment accepted for processing or re-refining. These records may take the form of a log, invoice, manifest, bill of lading or other shipping documents. Records for each shipment shall include all of the following information:
NR 679.56(1)(a) (a) The name and address of the transporter who delivered the used oil to the processor or re-refiner.
NR 679.56(1)(b) (b) The name and address of the generator or processor or re-refiner from whom the used oil was sent for processing or re-refining.
NR 679.56(1)(c) (c) The EPA identification number of the transporter who delivered the used oil to the processor or re-refiner.
NR 679.56(1)(d) (d) The EPA identification number (if applicable) of the generator or processor or re-refiner from whom the used oil was sent for processing or re-refining.
NR 679.56(1)(e) (e) The quantity of used oil accepted.
NR 679.56(1)(f) (f) The date of acceptance.
NR 679.56(2) (2) Delivery. Used oil processors or re-refiners shall keep a record of each shipment of used oil that is shipped to a used oil burner, processor or re-refiner or disposal facility. These records may take the form of a log, invoice, manifest, bill of lading or other shipping documents. Records for each shipment shall include all of the following information:

NR 679.56(2)(b) (b) The name and address of the burner, processor or re-refiner or disposal facility who will receive the used oil.

NR 679.56(2)(d) (d) The EPA identification number of the burner, processor or re-refiner or disposal facility who will receive the used oil.
NR 679.56(2)(e) (e) The quantity of used oil shipped.
NR 679.56(2)(f) (f) The date of shipment.
NR 679.56(3) (3) Record retention. The records described in subs. (1) and (2) shall be maintained for at least 3 years.

NR 679.57(1)(a)(a) The owner or operator shall keep a written operating record at the facility.
NR 679.57(1)(b) (b) All of the following information shall be recorded, as it becomes available, and maintained in the operating record until closure of the facility:

NR 679.57(1)(b)2. 2. Summary reports and details of all incidents that require implementation of the contingency plan as specified in s. NR 679.52 (2).
NR 679.57(2) (2) Reporting. A used oil processor or re-refiner shall report to the department on a biennial basis (by March 1 of each even numbered year), all of the following information concerning used oil activities during the previous calendar year:
NR 679.57(2)(a) (a) The EPA identification number, name and address of the processor or re-refiner.
NR 679.57(2)(b) (b) The calendar year covered by the report.
NR 679.57(2)(c) (c) The quantities of used oil accepted for processing or re-refining and the manner in which the used oil is processed or re-refined, including the specific processes employed.

NR 679.60 NR 679.60Applicability.
NR 679.60(1)(1)General. This subchapter applies to used oil burners, as defined in s. NR 679.01, except for facilities burning used oil for energy recovery under any of the following conditions:
NR 679.60(1)(a) (a) The used oil is burned by the generator in an on-site space heater according to s. NR 679.23.
NR 679.60(1)(b) (b) The used oil is burned by a processor or re-refiner for purposes of processing used oil, which is considered burning incidentally to used oil processing.
NR 679.60(2) (2) Other applicable provisions. Used oil burners who conduct any of the following activities are also subject to the requirements of the following subchapters:
