ASSEMBLY AMENDMENT 2, TO 2011 ASSEMBLY BILL 472

AB472-AA2,1,1 At the locations indicated, amend the bill as follows:

AB472-AA2,1,3 1. Page 1, line 2: after "petition" insert ", increasing a penalty for certain offenses relating to theft from a place of business,".

AB472-AA2,1,4 2. Page 2, line 1: after that line insert:

AB472-AA2,1,5 " Section 1d. 943.20 (3) (intro.) of the statutes is amended to read:

AB472-AA2,1,7 943.20 (3) Penalties. (intro.) Whoever Except as provided in sub. (3m), whoever violates sub. (1):

AB472-AA2, s. 1m Section 1m. 943.20 (3m) of the statutes is created to read:

AB472-AA2,1,12 943.20 (3m) Increased penalties. If the property is taken from a nonprofit corporation, a charitable trust, or any other nonprofit association that is described in section 501 (c) (3) or (4) of the Internal Revenue Code and the property is used by the person for partisan political purposes, whoever violates sub. (1) (b):

AB472-AA2,2,2 (a) If the value of the property does not exceed $2,500, is guilty of a Class I felony.

AB472-AA2,2,4 (b) If the value of the property exceeds $2,500 but does not exceed $5,000, is guilty of a Class H felony.

AB472-AA2,2,6 (c) If the value of the property exceeds $5,000 but does not exceed $10,000, is guilty of a Class G felony.

AB472-AA2,2,7 (d) If the value of the property exceeds $10,000, is guilty of a Class F felony.

AB472-AA2, s. 1r Section 1r. Initial applicability.

AB472-AA2,2,10 (1) This act first applies to acts committed on the effective date of this subsection.".
