ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 2011 SENATE BILL 15

SB15-ASA1,1,3 An Act to amend 16.964 (16) (b) (intro.), 349.027 (1) and 349.027 (2) of the statutes; relating to: collection and analysis of motor vehicle traffic stop information.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB15-ASA1, s. 1 Section 1. 16.964 (16) (b) (intro.) of the statutes is amended to read:

SB15-ASA1,1,7 16.964 (16) (b) (intro.) The office shall promulgate rules, for law enforcement agencies electing to collect traffic stop information as provided in s. 349.027 (1), relating to all of the following:

SB15-ASA1, s. 2 Section 2. 349.027 (1) of the statutes is amended to read:

SB15-ASA1,2,5 349.027 (1) Information collection required. For each motor vehicle stop made on or after January 1, 2011, by a law enforcement officer, the person in charge of the law enforcement agency employing the law enforcement officer shall may cause to be obtained all information relating to the traffic stop that is required to be collected under specified in rules promulgated under s. 16.964 (16) (b) 1. The person in charge of the law enforcement agency has the authority and discretion to determine whether the agency will collect traffic stop information under this subsection.

SB15-ASA1, s. 3 Section 3. 349.027 (2) of the statutes is amended to read:

SB15-ASA1,2,11 349.027 (2) Submission of information collected. The If a law enforcement agency collects traffic stop information as provided in sub. (1), the person in charge of a the law enforcement agency shall submit the information collected under sub. (1) to the office of justice assistance using the process, and in the format, prescribed by the rules promulgated under s. 16.964 (16) (b) 2.
