ASSEMBLY AMENDMENT 1, TO 2011 SENATE BILL 57

SB57-AA1,1,1 At the locations indicated, amend the bill as follows:

SB57-AA1,1,2 1. Page 11, line 3: after that line insert:

SB57-AA1,1,3 " Section 29m. 302.075 of the statutes is created to read:

SB57-AA1,1,5 302.075 Meals for inmates. (1) Except as provided in sub. (2), wardens and superintendents may provide no more than 2 meals daily to each inmate.

SB57-AA1,1,8 (2) A warden or superintendent may provide more than 2 meals daily to an inmate if a physician notifies the warden or superintendent that the inmate has a medical need for more than 2 meals daily.".

SB57-AA1,1,9 2. Page 19, line 21: after that line insert:

SB57-AA1,1,10 " Section 49m. 302.37 (1) (a) of the statutes is amended to read:

SB57-AA1,2,7 302.37 (1) (a) The sheriff or other keeper of a jail shall constantly keep it clean and in a healthful condition and pay strict attention to the personal cleanliness of the prisoners and shall cause the clothing of each prisoner to be properly laundered. The sheriff or keeper shall furnish each prisoner with clean water, towels, and bedding. The sheriff or keeper shall serve each prisoner 3 times daily with enough well-cooked, wholesome food. The county board shall prescribe an adequate diet for the prisoners in the county jail and may allow, at the discretion of the sheriff or keeper, the sheriff or keeper to provide each prisoner with no more than 2 meals daily unless a physician notifies the sheriff or keeper that an inmate has a medical need for more than 2 meals daily.".

SB57-AA1,2,8 3. Page 33, line 24: delete that line and substitute:

SB57-AA1,2,10 "(1) Except as provided in subsection (2), this act first applies to a person sentenced on December 31, 1999.".

SB57-AA1,2,11 4. Page 33, line 25: delete that line and substitute:

SB57-AA1,2,12 "(2)

SB57-AA1,2,14 (a) The treatment of sections 302.113 (1) and (2) (a) and (b) and 304.06 (1) (bg) of the statutes does not".

SB57-AA1,2,15 5. Page 34, line 2: delete "subsection" and substitute "paragraph".

SB57-AA1,2,16 6. Page 34, line 3: after that line insert:

SB57-AA1,2,18 "(b) The treatment of sections 302.075 and 302.37 (1) (a) of the statutes first applies to meals served on the effective date of this paragraph.".
