AB462-AA3,1,11 At the locations indicated, amend the bill as follows:
AB462-AA3,1,3 21. Page 2, line 8: delete lines 8 to 10 and substitute "explicit conduct is guilty
3of a Class A misdemeanor if all of the following apply:".
AB462-AA3,1,4 42. Page 2, line 10: after that line insert:
AB462-AA3,1,6 5"1. The actor intended to cause the person represented embarrassment or
6humiliation.
AB462-AA3,1,87 2. At least one person who is neither the actor nor the person represented
8viewed the representation.
AB462-AA3,1,119 3. The person represented did suffer embarrassment or humiliation as a result
10of the reproduction, distribution, exhibition, publication, transmission, or other
11dissemination of the representation.
AB462-AA3,2,3
14. The person represented consented to, or reasonably intended for, no one
2except the actor and the person himself or herself to capture, view, or possess the
3representation.
AB462-AA3,2,64 (am) The consent of the person represented to the capture of the representation
5or to the possession of the representation by the actor is not a defense to a violation
6of this subsection.".
