ASSEMBLY AMENDMENT 4, TO SENATE BILL 1

SB1-AA4,1,2 At the locations indicated, amend the bill, as shown by senate substitute amendment 2, as follows:

SB1-AA4,1,3 1. Page 119, line 7: delete lines 7 to 10.

SB1-AA4,1,5 2. Page 127, line 7: delete the material beginning with "Any" and ending with "law." on line 11.

SB1-AA4,1,9 3. Page 127, line 22: delete lines 22 and 23 and substitute "functional values of wetlands shall contain proposed projects for mitigation, including a schedule for implementing the projects, and all federal mitigation measures, if applicable. The department may not consider".

SB1-AA4,1,12 4. Page 128, line 2: after "schedule. " insert "In preparing the program, the applicant shall identify and consider mitigation that could be conducted within the same watershed in which the mining site is located.".

SB1-AA4,2,1 5. Page 128, line 3: delete lines 3 to 7.

SB1-AA4,2,3 6. Page 128, line 9: delete the material beginning with "For" and ending with "credit." on line 11.

SB1-AA4,2,5 7. Page 128, line 22: delete the material beginning with that line and ending with page 129, line 8, and substitute:

SB1-AA4,2,10 "(dm) Implementation of mitigation. Mitigation under a program under par. (am) for a wetland that is not a federal wetland shall be accomplished by implementation of a project by the applicant or other person approved by the department. Any additional conditions imposed by the department under sub. (7) for a federal wetland may be satisfied by implementing such a project.".

SB1-AA4,2,12 8. Page 129, line 10: delete lines 10 to 12 and substitute "the ceded territory, any mitigation that will be required to compensate for adverse".
