SB286-ASA1-AA1,1,11 At the locations indicated, amend the substitute amendment as follows:
SB286-ASA1-AA1,1,2 21. Page 20, line 8: after that line insert:
SB286-ASA1-AA1,1,3 3" Section 18m. 118.38 (1g) of the statutes is created to read:
SB286-ASA1-AA1,1,94 118.38 (1g) (a) A school board may request the department to waive the
5requirement under s. 118.425 (4) (a) to close a school or contract under s. 118.40 with
6a person to operate the school as a charter school if the school is the only elementary,
7middle, junior high, or high school operated by the school district. The department
8shall submit the request to the academic accountability council for its
9recommendation.
SB286-ASA1-AA1,2,210 (b) If a waiver is granted under this subsection, the school board shall take all
11of the actions required of the school board and operator of the charter school under

1s. 118.425 (4) (b) 1. and 2. and the new principal of the school shall determine the
2teachers employed for the school, subject to s. 118.425 (4) (b) 2.
SB286-ASA1-AA1,2,43 (c) Notwithstanding sub. (3), a waiver granted under this subsection is
4permanent.".
