939.625 Increased penalty for criminal gang crimes. (1) (a)
4Notwithstanding s. 939.22 (9), in this section, "criminal gang" means an ongoing
5organization, association, or group of 5 or more persons, whether formal or informal,
6that has as one of its primary activities the commission of one or more of the criminal
7acts, or acts that would be criminal if the actor were an adult, specified in s. 939.22
8(21) (a) to (s); that has a common name or a common identifying sign or symbol; and
9whose members individually or collectively engage in or have engaged in a pattern
10of criminal gang activity.

(am) If a person is convicted of a crime under chs. 939 to 948 or 961 committed
12for the benefit of, at the direction of, or in association with any criminal gang, with
13the specific intent to promote, further, or assist in any criminal conduct by a member
1of a criminal gang, the penalties for the underlying crime are increased as provided
2in par. (b).
