ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 544

AB544-AA1,1,1 At the locations indicated, amend the bill as follows:

AB544-AA1,1,3 1. Page 1, line 3: after "veterans" insert ", providing an exemption from emergency rule procedures, and requiring the exercise of rule-making authority".

AB544-AA1,1,4 2. Page 2, line 11: after "shall" insert "promulgate rules to".

AB544-AA1,1,5 3. Page 3, line 12: after that line insert:

AB544-AA1,1,6 " Section 2. Nonstatutory provisions.

AB544-AA1,2,3 (1) The department of natural resources may use the procedure under section 227.24 of the statutes to promulgate rules under section 29.054 (2) of the statutes, as created by this act. Notwithstanding section 227.24 (1) (c) and (2) of the statutes, emergency rules promulgated under this subsection remain in effect until July 1, 2018, or the date on which permanent rules take effect, whichever is sooner. Notwithstanding section 227.24 (1) (a) and (3) of the statutes, the department of natural resources is not required to provide evidence that promulgating a rule under this subsection as an emergency rule is necessary for the preservation of the public peace, health, safety, or welfare and is not required to provide a finding of emergency for a rule promulgated under this subsection.".
