ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 751

AB751-AA1,1,1 At the locations indicated, amend the bill as follows:

AB751-AA1,1,3 1. Page 1, line 8: after "program" insert "and the open enrollment transfer amount for children with disabilities".

AB751-AA1,1,4 2. Page 7, line 15: after that line insert:

AB751-AA1,1,6 " Section 19b. 118.51 (17) (a) of the statutes, as affected by 2015 Wisconsin Act 55, is renumbered 118.51 (17) (a) (intro.) and amended to read:

AB751-AA1,2,2 118.51 (17) (a) (intro.) In the 2015-16 school year Beginning in the 2016-17 school year and annually thereafter, for a child with a disability who satisfies all of the following, the resident school board shall pay to the nonresident school board, for each that child who is attending public school in the nonresident school district under this section and is receiving special education or related services under subch. V of ch. 115, with a disability tuition calculated using the daily tuition rate under s. 121.83 for such children enrolled in the nonresident school district, or, subject to par. (am), an amount agreed to by the school boards of the 2 school districts.:

AB751-AA1,19f Section 19f. 118.51 (17) (a) 1. to 4. of the statutes are created to read:

AB751-AA1,2,5 118.51 (17) (a) 1. The child attended a public school in a nonresident school district under this section in the 2015-16 school year.

AB751-AA1,2,7 2. The child received special education or related services under subch. V of ch. 115 in the public school described under subd. 1.

AB751-AA1,2,9 3. The child is attending the public school described under subd. 1. under this section in the current school year.

AB751-AA1,2,11 4. The child is receiving special education or related services under subch. V of ch. 115 in the current school year.

AB751-AA1,19k Section 19k. 118.51 (17) (am) of the statutes is created to read:

AB751-AA1,2,17 118.51 (17) (am) Following the review and revision under s. 115.787 (4) of the individualized education program of a child with a disability described in par. (a), the school boards of the resident school district and the nonresident school district may agree to modify the amount the resident school board will pay to the nonresident school board for that child with a disability.

AB751-AA1,19p Section 19p. 118.51 (17) (b) 1. a. of the statutes, as created by 2015 Wisconsin Act 55, is amended to read:

AB751-AA1,2,23 118.51 (17) (b) 1. a. For each school district, the number of nonresident pupils attending public school in the school district under this section , other than nonresident pupils described in par. (a), who are receiving special education or related services under subch. V of ch. 115.

AB751-AA1,19s Section 19s. 118.51 (17) (b) 1. b. of the statutes, as created by 2015 Wisconsin Act 55, is amended to read:

AB751-AA1,3,4 118.51 (17) (b) 1. b. For each school district, the number of resident pupils attending public school in a nonresident school district under this section, other than resident pupils described in par. (a), who are receiving special education or related services under subch. V of ch. 115 in the nonresident school district.

AB751-AA1,19w Section 19w. 118.51 (17) (b) 2. a. of the statutes, as created by 2015 Wisconsin Act 55, is amended to read:

AB751-AA1,3,10 118.51 (17) (b) 2. a. In the 2016-17 school year, the per pupil transfer amount for a child with a disability attending a public school in a nonresident school district under this section, other than a child with a disability described in par. (a), is $12,000.

AB751-AA1,19y Section 19y. 118.51 (17) (b) 2. b. of the statutes, as created by 2015 Wisconsin Act 55, is amended to read:

AB751-AA1,3,20 118.51 (17) (b) 2. b. Beginning in the 2017-18 school year, the per pupil transfer amount for a child with a disability attending a public school in a nonresident school district under this section, other than a child with a disability described in par. (a), is the sum of the per pupil transfer amount for the previous school year; the amount of the per pupil revenue limit adjustment under s. 121.91 (2m) for the current school year, if positive; and the change in the amount of statewide categorical aid per pupil between the previous school year and the current school year, as determined under s. 118.40 (2r) (e) 2p., if positive.".
