ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 8

AB8-AA1,1,1 At the locations indicated, amend the bill as follows:

AB8-AA1,1,4 1. Page 1, line 2: after “programs" insert “, coverage of mental health services and addiction treatment under the Medical Assistance program and health insurance policies and plans,".

AB8-AA1,1,5 2. Page 1, line 3: before that line insert:

AB8-AA1,1,6 “ Section 1d. 49.46 (2) (bh) of the statutes is created to read:

AB8-AA1,1,11 49.46 (2) (bh) Benefits provided under par. (b) shall include inpatient and outpatient care provided to evaluate, diagnose, and treat a mental health condition or substance use disorder, including behavioral health treatment such as psychotherapy and counseling, mental and behavioral health inpatient services, and treatment of a substance use disorder.”.

AB8-AA1,1,12 3. Page 2, line 5: after that line insert:

AB8-AA1,2,1 “ Section 1m. 609.716 of the statutes is created to read:

AB8-AA1,2,4 609.716 Coverage of mental health services and substance use disorder treatment. Defined network plans and preferred provider plans are subject to s. 632.895 (14d).

AB8-AA1,1r Section 1r. 632.895 (14d) of the statutes is created to read:

AB8-AA1,2,16 632.895 (14d) Mental health services and substance abuse treatment. Every disability insurance policy and every self-insured health plan of the state or of a county, city, town, village, or school district shall provide coverage for inpatient and outpatient care provided to evaluate, diagnose, and treat a mental health condition or substance use disorder, including behavioral health treatment, such as psychotherapy and counseling, mental and behavioral health inpatient services, and substance use disorder treatment. Coverage required under this subsection includes coverage for preexisting mental health conditions and substance use disorders an individual has before the first date of coverage by the policy or plan. Mental health parity and cost-sharing equity requirements in s. 632.89 (2) and (3) apply to the coverage required under this subsection.”.

AB8-AA1,2,18 “ Section 2g. Initial applicability.

AB8-AA1,2,19 (1) Insurance coverage for mental health and substance abuse treatment.

AB8-AA1,2,23 (a) For policies and plans containing provisions inconsistent with this act, the treatment of sections 609.716 and 632.895 (14d) of the statutes first applies to policy or plan years beginning on January 1 of the year following the year in which this paragraph takes effect, except as provided in paragraph (b).

AB8-AA1,3,5 (b) For policies and plans that are affected by a collective bargaining agreement containing provisions inconsistent with this act, the treatment of sections 609.716 and 632.895 (14d) of the statutes first applies to policy or plan years beginning on the effective date of this paragraph or on the day on which the collective bargaining agreement is newly established, extended, modified, or renewed, whichever is later.

AB8-AA1,2r Section 2r. Effective dates. This act takes effect on the day after publication, except as follows:

AB8-AA1,3,10 (1) Insurance coverage for mental health and substance abuse treatment. The treatment of sections 609.716 and 632.895 (14d) of the statutes and Section 2g of this act take effect on the first day of the 4th month beginning after publication.”.
