AB8-AA1,1,11 At the locations indicated, amend the bill as follows:
AB8-AA1,1,4 21. Page 1, line 2: after “programs" insert “, coverage of mental health services
3and addiction treatment under the Medical Assistance program and health
4insurance policies and plans,".
AB8-AA1,1,5 52. Page 1, line 3: before that line insert:
AB8-AA1,1,6 6 Section 1d. 49.46 (2) (bh) of the statutes is created to read:
AB8-AA1,1,117 49.46 (2) (bh) Benefits provided under par. (b) shall include inpatient and
8outpatient care provided to evaluate, diagnose, and treat a mental health condition
9or substance use disorder, including behavioral health treatment such as
10psychotherapy and counseling, mental and behavioral health inpatient services, and
11treatment of a substance use disorder.”.

1 Section 1m. 609.716 of the statutes is created to read:
AB8-AA1,2,4 2609.716 Coverage of mental health services and substance use
3disorder treatment.
Defined network plans and preferred provider plans are
4subject to s. 632.895 (14d).
AB8-AA1,1r 5Section 1r. 632.895 (14d) of the statutes is created to read:
AB8-AA1,2,166 632.895 (14d) Mental health services and substance abuse treatment. Every
7disability insurance policy and every self-insured health plan of the state or of a
8county, city, town, village, or school district shall provide coverage for inpatient and
9outpatient care provided to evaluate, diagnose, and treat a mental health condition
10or substance use disorder, including behavioral health treatment, such as
11psychotherapy and counseling, mental and behavioral health inpatient services, and
12substance use disorder treatment. Coverage required under this subsection includes
13coverage for preexisting mental health conditions and substance use disorders an
14individual has before the first date of coverage by the policy or plan. Mental health
15parity and cost-sharing equity requirements in s. 632.89 (2) and (3) apply to the
16coverage required under this subsection.”.

AB8-AA1,2,18 18 Section 2g. Initial applicability.
AB8-AA1,2,1919 (1) Insurance coverage for mental health and substance abuse treatment.
AB8-AA1,2,2320 (a) For policies and plans containing provisions inconsistent with this act, the
21treatment of sections 609.716 and 632.895 (14d) of the statutes first applies to policy
22or plan years beginning on January 1 of the year following the year in which this
23paragraph takes effect, except as provided in paragraph (b).

1(b) For policies and plans that are affected by a collective bargaining agreement
2containing provisions inconsistent with this act, the treatment of sections 609.716
3and 632.895 (14d) of the statutes first applies to policy or plan years beginning on the
4effective date of this paragraph or on the day on which the collective bargaining
5agreement is newly established, extended, modified, or renewed, whichever is later.
AB8-AA1,2r 6Section 2r. Effective dates. This act takes effect on the day after publication,
7except as follows:
AB8-AA1,3,10 8(1) Insurance coverage for mental health and substance abuse treatment.
9The treatment of sections 609.716 and 632.895 (14d) of the statutes and Section 2g
10of this act take effect on the first day of the 4th month beginning after publication.”.
