AB479-ASA1-AA3,1,1 At the locations indicated, amend the substitute amendment as follows:

AB479-ASA1-AA3,1,2 1. Page 4, line 8: after that line insert:

AB479-ASA1-AA3,1,3 “ Section 1m. 30.20 (1r) (a) of the statutes is amended to read:

AB479-ASA1-AA3,1,9 30.20 (1r) (a) A person may submit to the department a written statement requesting that the department determine whether a proposed activity is exempt under sub. (1g), except that a person shall submit a written statement requesting that the department determine whether a proposed activity is exempt under sub. (1g) (d). The statement shall contain a description of the proposed activity and site and shall give the department consent to enter and inspect the site.”.

AB479-ASA1-AA3,1,11 “ Section 7m. 59.692 (1e) of the statutes is created to read:

AB479-ASA1-AA3,2,4 59.692 (1e) (a) Before conducting any activity that is regulated under a county's shoreland zoning ordinance within 1,000 feet of a pond described under sub. (1) (am) 1. to 4., a person shall submit to the county a written statement requesting that the county determine whether the pond is a navigable water.

AB479-ASA1-AA3,2,6 (b) The county shall do all of the following after receipt of a statement under par. (a):

AB479-ASA1-AA3,2,8 1. Enter and inspect the site on which the activity is located if the county determines such an inspection is necessary.

AB479-ASA1-AA3,2,10 2. Make a determination as to whether the pond is a navigable water and notify the person in writing.”.
