AB69-ASA1-AA3,1,2 1. Page 1, line 3: after “use" insert “and making an appropriation".

AB69-ASA1-AA3,1j Section 1j. 20.435 (4) (bx) of the statutes is created to read:

AB69-ASA1-AA3,2,4 20.435 (4) (bx) Investigational drug, device, and biological product assistance program. Biennially, the amounts in the schedule for assisting lower income persons to afford investigational drug, device, and biological product costs under s. 49.689.

AB69-ASA1-AA3,1p Section 1p. 49.689 of the statutes is created to read:

AB69-ASA1-AA3,2,8 49.689 Investigational drug, device, and biological product assistance program. (1) In this section, “investigational drug, device, or biological product” has the meaning given in s. 450.135 (1) (b).

AB69-ASA1-AA3,2,11 (2) From the appropriation under s. 20.435 (4) (bx), the department shall pay the costs of an investigational drug, device, or biological product for an individual who is eligible under sub. (3).

AB69-ASA1-AA3,2,13 (3) An individual is eligible to receive the payment specified under sub. (2) if he or she meets all of the following criteria:

AB69-ASA1-AA3,2,14 (a) He or she has residence in this state.

AB69-ASA1-AA3,2,15 (b) He or she is an eligible patient, as defined in s. 450.135 (1) (a).

AB69-ASA1-AA3,2,17 (c) He or she is an individual whose annual gross household income is at or below 250 percent of the poverty line.

AB69-ASA1-AA3,2,20 (4) The department shall determine the eligibility of individuals applying for payment of costs under this section and establish a schedule of payment based on the ability of individuals to pay.”.

AB69-ASA1-AA3,2,21 3. Page 4, line 22: after that line insert:

AB69-ASA1-AA3,2,22 “ Section 2m. Effective date.

AB69-ASA1-AA3,3,3 (1) The treatment of sections 20.435 (4) (bx) and 49.689 of the statutes takes effect on the day after publication, or on the 2nd day after publication of the 2017 biennial budget act, whichever is later.”.
