ASSEMBLY AMENDMENT 2, TO ASSEMBLY BILL 749

AB749-AA2,1,1 At the locations indicated, amend the bill as follows:

AB749-AA2,1,3 1. Page 1, line 4: delete “auxiliaries" and substitute “auxiliaries, providing an exemption from emergency rule procedures,".

AB749-AA2,1,4 2. Page 7, line 3: after that line insert:

AB749-AA2,1,5 “ Section 14. Nonstatutory provisions.

AB749-AA2,2,3 (1) Emergency rules. Using the procedure under section 227.24 of the statutes, the dentistry examining board shall promulgate the rules for the certification and practice of expanded function dental auxiliaries required under section 447.035 (3) of the statutes. Notwithstanding section 227.24 (1) (c) and (2) of the statutes, a rule promulgated under this subsection may remain in effect until May 1, 2019, or the date on which permanent rules take effect, whichever is sooner. Notwithstanding section 227.24 (1) (a) and (3) of the statutes, the dentistry examining board is not required to provide evidence that promulgating a rule under this subsection as an emergency rule is necessary for the preservation of the public peace, health, safety, or welfare and is not required to provide a finding of emergency for a rule promulgated under this subsection.

AB749-AA2,15 Section 15. Effective date.

AB749-AA2,2,6 (1) This act takes effect on the first day of the 10th month beginning after publication.”.
