ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 903

AB903-AA1,1,1 At the locations indicated, amend the bill as follows:

AB903-AA1,1,4 1. Page 1, line 9: after “boards" insert “, the nursing workforce survey, extending the time limit for emergency rule procedures, and providing an exemption from emergency rule procedures".

AB903-AA1,1,5 2. Page 5, line 11: after that line insert:

AB903-AA1,1,6 “ Section 13m. 106.30 (1) of the statutes is repealed.”.

AB903-AA1,1,8 3. Page 6, line 12: delete the material beginning with that line and ending with page 7, line 9, and substitute:

AB903-AA1,1,9 “ Section 21c. 441.01 (7) (a) (intro.) of the statutes is amended to read:

AB903-AA1,1,13 441.01 (7) (a) (intro.) The board shall require request that each applicant for the renewal of a registered nurse or licensed practical nurse license, certificate, or permit issued under this chapter to do all of the following as a condition for when renewing the license, certificate, or permit:

AB903-AA1,22c Section 22c. 441.01 (7) (a) 1. of the statutes is amended to read:

AB903-AA1,2,4 441.01 (7) (a) 1. Complete and submit to the department with the application for renewal of the license, certificate, or permit a nursing workforce survey developed by the department of workforce development under s. 106.30 (2).

AB903-AA1,23c Section 23c. 441.01 (7) (b) of the statutes is amended to read:

AB903-AA1,2,10 441.01 (7) (b) The board may not require that an applicant complete the nursing workforce survey or pay the nursing workforce survey fee in order to renew a registered nurse or licensed practical nurse license, certificate, or permit under this chapter unless the renewal applicant has completed the nursing workforce survey to the satisfaction of the board.

AB903-AA1,2,12 (c) The board shall may establish standards to determine whether the survey has been completed.

AB903-AA1,2,15 (d) The board shall, by no later than June 30 of each odd-numbered year, submit all completed nursing workforce survey forms to the department of workforce development.”.

AB903-AA1,2,17 “ Section 25m. 441.10 (6) of the statutes is amended to read:

AB903-AA1,3,2 441.10 (6) On or before the applicable renewal date specified under s. 440.08 (2) (a), a licensed practical nurse practicing for compensation shall submit to the board, on forms furnished by the department, an application for license renewal, together with a statement giving name, residence, nature and extent of practice as a licensed practical nurse during the prior year and prior unreported years, the nursing workforce survey and fee required under s. 441.01 (7), and other facts bearing upon current competency that the board requires, accompanied by the applicable license renewal fee determined by the department under s. 440.03 (9) (a).”.

AB903-AA1,3,4 “ Section 31m. Nonstatutory provisions.

AB903-AA1,3,13 (1m) The board of nursing may promulgate emergency rules under section 227.24 of the statutes necessary to implement this act. Notwithstanding section 227.24 (1) (c) and (2) of the statutes, emergency rules promulgated under this subsection remain in effect until May 1, 2019, or the date on which permanent rules take effect, whichever is sooner. Notwithstanding section 227.24 (1) (a) and (3) of the statutes, the board is not required to provide evidence that promulgating a rule under this subsection as an emergency rule is necessary for the preservation of the public peace, health, safety, or welfare and is not required to provide a finding of emergency for a rule promulgated under this subsection.

AB903-AA1,32m Section 32m. Initial applicability.

AB903-AA1,3,18 (1m) The treatment of sections 441.07 (7) (a) (intro.) and 1. and (b), 441.08, 441.15 (3) (b), and 441.16 (3) (d) of the statutes first applies to renewals of a license, permit, or registration for a renewal that occurs on the effective date of this subsection.”.
