TO SENATE BILL 53

SB53-SA1,1,11 At the locations indicated, amend the bill as follows:
SB53-SA1,2,3 21. Page 2, line 13: delete lines 13 to 22 and substitute “violation of a law for
3which the maximum period of imprisonment is 6 years or less,
, the person may file,
4in each county of conviction, a petition designed by the director of state courts
5requesting that the record of the crime be expunged. The person shall pay to the clerk
6of circuit court a $100 fee for each petition filed. The court shall deny the petition
7without a hearing if the court determines that the person is not eligible for
8expungement under this subdivision, subd. 3. applies, the person has been convicted
9of a crime since successfully completing the sentence for the crime that is the subject
10of the petition, criminal charges are pending against the person, or the person has
11previously had a petition denied under this subdivision regarding the same crime
12that is the subject of the current petition. Otherwise, upon receipt of the petition, the
13court shall schedule a hearing to review the petition. At the hearing,
the court may

1order at the time of sentencing that the record be expunged upon successful
2completion of the sentence
if the court determines the person will benefit and society
3will not be harmed by this disposition.”.
SB53-SA1,2,5 42. Page 3, line 20: delete the material beginning with “clerk" and ending with
5“filed" on line 21 and substitute “district attorney”.
SB53-SA1,2,6 63. Page 4, line 3: before “provide" insert “testify or".
SB53-SA1,2,8 74. Page 4, line 4: delete “clerk of the circuit court" and substitute “district
8attorney".
SB53-SA1,2,9 95. Page 4, line 18: after that line insert:
SB53-SA1,2,10 10 Section 6m. Initial applicability.
SB53-SA1,2,12 11(1) This act first applies to a person who is sentenced, or placed on probation,
12on the effective date of this subsection.”.
