Under current law, to participate in a public library system a municipal, county, or joint public library (local library) or a county must meet a maintenance of effort requirement. A county must maintain its financial support for library services at a level not lower than the average support of the previous three years. A local library must receive total funding from its governing body in an amount of not less than the average amount of the previous three years. This bill repeals these maintenance of effort requirements.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
Section 1. 43.15 (2) (a) of the statutes is renumbered 43.15 (2).
Section 2. 43.15 (2) (b) to (e) of the statutes are repealed.
Section 3. 43.15 (4) (c) 5. of the statutes is repealed.
Section 4. 43.15 (4) (e) of the statutes is repealed.
Section 5. 43.15 (5) of the statutes is amended to read:
43.15 (5) Capital costs excluded. For the purpose of determining the amount of financial support required under subs. (2) (b) and sub. (4) (b) 2. and (c) 5., amounts spent for capital projects shall be excluded.
Section 6. 43.53 (2) (a) of the statutes is amended to read:
43.53 (2) (a) Name one of the participants as the library's fiscal agent, who is responsible for the payroll, benefit administration, insurance, and financial record keeping and auditing for the library. The participant's costs of providing the services under this paragraph count toward the financial support required of the participant under s. 43.15 (2) (b) or (4) (b) 2. or (c) 5.
