1995 Assembly Resolution 31
ENGROSSED RESOLUTION
To renumber assembly rule 90; to amend assembly rules 10 (1m) (intro.), 42 (3) (c), 45 (1) and 95 (82) and (90); and to create assembly rules 10 (3) and 90 (2); relating to: suspension of the 8 p.m. ending time of the daily sessions of the assembly, creation of and rereferral of proposals to special committees, and subsequent reference of proposals.
Resolved by the assembly, That:
AR31, s. 1 Section 1. Assembly rule 10 (1m) (intro.), as affected by 1995 Assembly Resolution 2, is amended to read:
Assembly Rule 10 (1m) (intro.) Special committees may be created by the speaker by written order and may be created by resolution. Any such committee shall cease to exist:
AR31, s. 2 Section 2. Assembly rule 10 (3) is created to read:
Assembly Rule 10 (3) A special committee or temporary special committee may not be created by written order unless no additional legislative employe will be hired to staff the special committee.
AR31, s. 3 Section 3. Assembly rule 42 (3) (c), as created by 1995 Assembly Resolution 2, is amended to read:
Assembly Rule 42 (3) (c) Within 5 working days after initial referral by the speaker under sub. (1) (b) or (c) (a) to a committee, the speaker, with consent of the chairperson and notwithstanding rule 15, may withdraw any bill, joint resolution or resolution from the standing committee to which it is referred and rerefer it to another standing committee or to a special committee. Rereferral under this rule may not be used to satisfy section 13.093 (1) of the statutes.
AR31, s. 4 Section 4. Assembly rule 45 (1), as affected by 1995 Assembly Resolution 2, is amended to read:
Assembly Rule 45 (1) Whenever a committee reports on a proposal referred to that committee, the speaker shall refer or rerefer the proposal, except as otherwise provided in subs. (2) and (3), to either the calendar for the 2nd legislative day thereafter for 2nd reading or, to the committee on rules for calendar scheduling or to another standing or special committee, unless it is his or her judgment that reference of the proposal to the joint committee on finance is required by law or rule and the speaker refers the proposal to that committee. On any legislative day when copies of a committee report, showing the speaker's subsequent referrals, have been distributed to the members prior to the 3rd order of business, such report shall not be read by the chief clerk to the members, but the content of the committee report and the speaker's referrals and rereferrals shall be reproduced in the journal.
AR31, s. 5 Section 5. Assembly rule 90 is renumbered assembly rule 90 (1).
AR31, s. 6 Section 6. Assembly rule 90 (2) is created to read:
Assembly Rule 90 (2) Rule 28 (2) may be suspended by a majority of the members present and voting, but the suspension under this subsection only applies to the completion of the consideration of the proposal that is being considered at 8 p.m.
AR31, s. 7 Section 7. Assembly rule 95 (82), as affected by 1995 Assembly Resolution 2, is amended to read:
Assembly Rule 95 (82) Special committee: A committee created by a resolution, or a special committee or temporary special committee created by a written order of the speaker under rule 10, to investigate specific matters during a session or committee work period, and report to the assembly.
AR31, s. 8 Section 8. Assembly rule 95 (90) is amended to read:
Assembly Rule 95 (90) Suspension of the rules: A motion requiring two-thirds majority support or a motion under rule 90 (2) requiring majority support and by which a special action on a specific proposal is accomplished despite the existence of a rule blocking such action. Any suspension of the rules is temporary.
