You have asked for a formal opinion on whether the promulgation of rules that prescribe the use of risk-based methodologies, such as the American Society for Testing and Material's Risk-Based Corrective Action, to respond to petroleum contamination under Wisconsin's Petroleum Environmental Cleanup Fund, would be consistent with the provisions in Wis. Stat. ch.
160 ("chapter 160"). The attached is in response to your request for an opinion.

The "Written Hiring Reasons Report" for Wisconsin Sate Government covering the period July 1, 1997, through June 30, 1998, is enclosed. The report, required under ss.
230.25 (1p) and
230.27 (2k), Wis. Stats., identifies the types and reasons for classified and project appointments in 1998. This information can be useful as a monitoring tool for classified and project appointments. The law requires "written hiring reasons" for certain hiring transactions and requires the Department of Employment Relations to summarize the hiring reasons and prepare an annual report.
Information for this report came from summary information furnished by hiring supervisors and provided by each agency. Your efforts and cooperations in compiling the summary reports is appreciated. The report includes a summary and information for each state agency and UW System unit.
