The 1999-2001 State of Wisconsin Biennial Budget, 1999 Wisconsin Act 9, included a provision to change the University of Wisconsin System's appropriation for tuition and fee revenues (Academic Student Fees, Fund 131) from an annual, sum certain appropriation to a continuing appropriation.

Wisconsin Act 9 required the Board of Regents to report annually, beginning on December 15, 2000, the amount by which actual expenditures in the previous fiscal year, in this case 2009-10, exceeded the amount in the schedule for that appropriation in the previous fiscal year. That report, including the purposes for which the additional revenues were spent and the amount spent for each purpose, is attached.

Also available from the Wisconsin Government Accountability Board are reports identifying the amount and value of time state agencies have spent to affect legislative action and reports of expenditures for lobbying activities filed by organizations that employ lobbyists.

The Honorable, The Legislature:

As part of the State's Comprehensive Annual Financial Report for fiscal year (FY) 2009-10, which was published by the Department of Administration last month, we issued an unqualified audit opinion and, in a management letter provided to the Joint Legislative Audit Committee on December 17, 2010, described certain concerns with internal control over financial reporting and compliance that we are required to report under Government Auditing Standards. During the course of our audit, we also identified two other matters that are not required to be reported under Government Auditing Standards but that deserve attention:

• $19.4 million was lapsed from certain program revenue appropriations with insufficient cash to cover the lapses; and

S76 • expenditures of $25.9 million were incurred during FY 2009-10 but charged to FY 2010-11 accounts.

In combination, actions to address the $19.4 million in lapses and $25.9 million in expenditures charged to FY 2010-11 accounts would reduce the General Fund's undesignated fund balance by $45.3 million.

We bring these matters to your attention in an effort to prevent similar occurrences in the future.

We have completed a financial audit of WHA Television, as requested by the University of Wisconsin-Extension to fulfill the audit requirements of the Corporation for Public Broadcasting. The Corporation requires audited financial statements of public broadcasting entities to determine future funding levels.

WHA Television is licensed to the University of Wisconsin System's Board of Regents and is operated by the University of Wisconsin-Extension. WHA Television earned $17.3 million in revenues during fiscal year 2009-10, including state support, member contributions, funding from the Corporation for Public Broadcasting, and various other grants.
