Senator Miller, with unanimous consent, asked that the Senate adjourn in honor of the 50th anniversary of the unanimous decision of the US Supreme Court in the case of Loving vs Virginia which held, in words of Chief Justice Earl Warren, that "Under our Constitution, the freedom to marry, or not marry, a person of another race reside with the individual, and cannot be infringed by the State." At the time of the decision in 1967, 16 states had laws that prohibited members of the white race from marrying a non-white. In most of these states, an interracial marriage that was legal in another state was void in the state with the interracial prohibition and children of such a union were officially bastards. This Supreme Court Loving decision is person to Senator Miller and his wife, who is a second generation Japanese-American. They married in 1968 while he was an Air Force pilot training in Selma, Alabama. Alabama was one of those states that prohibited intermarriage between whites and non-whites. They were grateful then for the decision one year earlier that made their marriage legal in Alabama. They are grateful today that freedom to marry the person you love is the law of our nation.
