Analysis by the Legislative Reference Bureau
With certain exceptions, current law prohibits a person from doing any of the
following unless he or she is licensed as a physical therapist: practicing physical
therapy; designating himself or herself as a physical therapist; or using or assuming
the title "physical therapist", "physiotherapist", "physical therapy technician" or
other titles, letters or designations which represent or may tend to represent the
person as a physical therapist. This prohibition does not apply to a person who is
lawfully practicing within the scope of a license, permit, registration or certification
granted by this state or the federal government, to certain persons who are assisting
a physical therapist in practice while under the supervision of the physical therapist,
to a physical therapy student who is practicing physical therapy within the scope of
the student's education or training, or to a physical therapist who is licensed to
practice physical therapy in another state or country and is providing a consultation
or demonstration with a physical therapist who is licensed in this state.
This bill prohibits any person, without exception, from claiming to render
physical therapy or physiotherapy services unless he or she is licensed as a physical
therapist.
