AB301,1,3 1An Act to amend 346.60 (2) (a) and 346.60 (3m); and to create 343.32 (2) (bw)
2and 346.60 (6) of the statutes; relating to: violations of speed limits of 55 miles
3per hour and providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law, with certain exceptions, no person may operate a motor
vehicle at any speed faster than the posted maximum speed or, where no maximum
speed is posted, 55 miles per hour. A person who violates a maximum speed limit of
55 miles per hour may be required to forfeit not less than $30 nor more than $300.
The minimum and maximum forfeitures are doubled for a violation occurring in a
highway maintenance or construction area.
Under this bill, a person who violates a speed limit of 55 miles per hour by not
more than 15 miles per hour may be required to forfeit $5. This reduced forfeiture
only applies to violations occurring on any interstate highway or on certain portions
of STH 78 or USH 51. Also under the bill, no demerit points may be assessed for a
violation that is punishable by the reduced forfeiture. The bill does not affect the
forfeitures applicable to a violation occurring in a highway maintenance or
construction area.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB301, s. 1 4Section 1. 343.32 (2) (bw) of the statutes is created to read:

1343.32 (2) (bw) The scale adopted by the secretary may not assess any demerit
2points for a violation of s. 346.57 (4) (h) or (5) that is punishable under s. 346.60 (6)
3(b).
AB301, s. 2 4Section 2. 346.60 (2) (a) of the statutes is amended to read:
AB301,2,75 346.60 (2) (a) Except as provided in sub. (3m) or (5), any person violating s.
6346.57 (4) (d) to (g) or (h) or (5) or 346.58 may be required to forfeit not less than $30
7nor more than $300.
AB301, s. 3 8Section 3. 346.60 (3m) of the statutes is amended to read:
AB301,2,129 346.60 (3m) If an operator of a vehicle violates s. 346.57 (2), (3) or (4) (d) to (h)
10where persons engaged in work in a highway maintenance or construction area are
11at risk from traffic, any applicable minimum and maximum forfeiture specified in
12sub. (2) or, (3) or (6) for the violation shall be doubled.
AB301, s. 4 13Section 4. 346.60 (6) of the statutes is created to read:
AB301,2,1614 346.60 (6) (a) Except as provided in par. (b) or sub. (3m) or (5), any person who
15violates s. 346.57 (4) (h) or (5) may be required to forfeit not less than $30 nor more
16than $300.
AB301,2,2317 (b) Any person who violates s. 346.57 (4) (h) or (5) on any interstate highway
18as defined in s. 84.30 (2) (f), on STH 78 between the I 90/94 interchange and USH 51,
19or on USH 51 between STH 78 and the Prairie River in Lincoln County, by exceeding
20a speed limit of 55 miles per hour by not more than 15 miles per hour, may be required
21to forfeit $5. This paragraph does not apply if the violation occurred where persons
22engaged in work in a highway maintenance or construction area are at risk from
23traffic.
