AB326,1,2 1An Act to create 19.59 (1) (e) and (em) of the statutes; relating to: conflicts of
2interest by local public officials.

This bill prohibits any elective or major appointive official of a local government
from representing a person for compensation before a local government with respect
to a matter if the official is authorized to take official action requiring the exercise
of discretion with respect to that matter. The bill also prohibits such an official from
taking official action with respect to a matter before a subunit of a local government
if the official has discretion with respect to the matter and the official has a financial
interest in another's representation of a person before that subunit with respect to
that matter. Currently, there are no such restrictions.
Violators are subject to a forfeiture (civil penalty) of not more than $1,000 for
each violation.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB326, s. 1 3Section 1. 19.59 (1) (e) and (em) of the statutes are created to read:
AB326,1,74 19.59 (1) (e) No local public official may represent a person for compensation
5before a board, council, commission, committee or other subunit of a local
6governmental unit with respect to a matter if the official is authorized to take official
7action requiring the exercise of discretion with respect to that matter.
AB326,2,38 (em) No local public official may take official action with respect to a matter
9before a board, council, commission, committee or other subunit of a local

1governmental unit if the official has discretion with respect to that matter and the
2official has a financial interest in another's representation of a person before that
3subunit with respect to that matter.
