(intro.) and 134.66 (2) (cm) 1. of the statutes; relating to: cigarette vending machines.

Analysis by the Legislative Reference Bureau

Under current law, no retailer may keep a cigarette vending machine in any public place that is open to persons under the age of 18 unless the vending machine is in plain view and control of an employe, is in a location inaccessible to the public when the premises are closed and is more than 500 feet from a school.

This bill prohibits a retailer from keeping a cigarette vending machine in any public place that is open to persons under the age of 18, without exception.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB359, s. 1 Section 1. 134.66 (2) (c) 1. (intro.) of the statutes is renumbered 134.66 (2) (c) and amended to read:

AB359,1,9 134.66 (2) (c) Except as provided in par. (cm), no No retailer may keep a vending machine in any public place that is open to persons under the age of 18 unless all of the following apply:.

AB359, s. 2 Section 2. 134.66 (2) (c) 1. a. of the statutes is repealed.

AB359, s. 3 Section 3. 134.66 (2) (c) 1. b. of the statutes is repealed.

AB359, s. 4 Section 4. 134.66 (2) (c) 2. of the statutes is repealed.

AB359, s. 5 Section 5. 134.66 (2) (c) 3. of the statutes is repealed.

AB359, s. 6 Section 6. 134.66 (2) (c) 4. of the statutes is repealed.

AB359, s. 7 Section 7. 134.66 (2) (cm) 1. of the statutes is renumbered 134.66 (2) (cm) and amended to read:

AB359,2,8 134.66 (2) (cm) Notwithstanding par. (c), no No retailer may place a vending machine within 500 feet of a school.

AB359, s. 8 Section 8. 134.66 (2) (cm) 2. of the statutes is repealed.

AB359, s. 9 Section 9. 134.66 (2) (cm) 3. of the statutes is repealed.
