AB39,1,2 1An Act to repeal 94.64 (4) (g); and to amend 94.72 (6) (c) of the statutes;
2relating to: statement of fertilizer and commercial feed fees on invoices.
Analysis by the Legislative Reference Bureau
Under current law, manufacturers and distributers of fertilizer and of
commercial animal feed are required to pay certain fees to the department of
agriculture, trade and consumer protection. Current law prohibits those persons
from indicating the amount of those fees on invoices for fertilizer or commercial
animal feed. This bill eliminates that prohibition.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB39, s. 1 3Section 1. 94.64 (4) (g) of the statutes is repealed.
AB39, s. 2 4Section 2. 94.72 (6) (c) of the statutes is amended to read:
AB39,2,35 94.72 (6) (c) Invoice or receipt. A manufacturer or distributor who distributes
6commercial feed to another manufacturer or distributor except an exempt buyer
7shall indicate on the invoice or sales receipt that the inspection fees have been or will
8be paid either by the manufacturer or distributor who distributes the commercial
9feed or by a prior manufacturer or distributor in the chain of distribution. If a
10manufacturer or distributor distributes commercial feed to any person other than
11another manufacturer or distributor and charges to that person the amount of an

1inspection fee that the manufacturer or distributor is required to pay, the
2manufacturer or distributor may not indicate the charge for the fee on the invoice or
3sales receipt.
