AB403,1,3 1An Act relating to: requesting the joint legislative council to study state and
2federal capitol view and other historic monument and building view
3preservation laws.
Analysis by the Legislative Reference Bureau
This bill requests the joint legislative council to study the capitol view and other
historic monument and building view preservation laws of all states with such laws,
the United States and the District of Columbia, and to submit a report to the
appropriate standing committees of the legislature and to the governor. The report
shall include recommended statutory changes to enhance, promote, preserve and
protect the view of the state capitol building of this state, including statutory changes
affecting joint long-range zoning and development plans, the tax increment law and
historic preservation efforts.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB403, s. 1 4Section 1. Nonstatutory provisions; legislature.
AB403,2,14 5(1)  Joint legislative council. The joint legislative council is requested to
6study the state and federal capitol view and other historic monument and building
7view preservation laws of all states with such laws, the United States and the
8District of Columbia to determine the extent to which height restrictions, local

1zoning laws, development plans, park space laws, historic preservation laws and
2laws substantially similar to the tax increment law under section 66.46 of the
3statutes are imposed by such laws on buildings or structures located near the
4applicable state capitol or the U.S. capitol. The study shall determine those statutory
5changes that are needed to enhance, promote, preserve and protect the view of the
6state capitol building, including statutory changes affecting joint long-range zoning
7and development plans of the state and local governmental jurisdictions, other local
8zoning and development plans, park space, historic preservation efforts and the tax
9increment law under section 66.46 of the statutes that would foster the preservation
10and protection of the state capitol view. The joint legislative council shall report its
11conclusions, including recommended statutory changes, on or before July 1, 1995, or
12the first day of the 3rd month beginning after the effective date of this subsection,
13whichever is later, to the chief clerk of each house for distribution to the appropriate
14standing committees under section 13.172 (3) of the statutes and to the governor.
