AB482,1,2 1An Act to create 631.87 of the statutes; relating to: restrictions on insurer
2access to pupils' grades.

Under current law, pupil records containing a pupil's grades are confidential
and may be revealed by a school only under certain circumstances, including upon
the written permission of the parent or legal guardian of a minor pupil. This bill
prohibits an insurer from requesting or requiring a policyholder or an applicant for
insurance to reveal, or to provide permission for a school to disclose or make available
to the insurer, the grades of a minor pupil who is a child or legal ward of the
policyholder or insurance applicant. An insurer may, however, request or require a
policyholder or an applicant for insurance to reveal whether a minor pupil who is a
child or legal ward of the policyholder or applicant has at least a 3.0 grade point
average or its equivalent.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB482, s. 1 3Section 1. 631.87 of the statutes is created to read:
AB482,1,4 4631.87 Restrictions on access to pupils' grades. (1) In this section:
AB482,1,65 (a) "Home-based private educational program" has the meaning given in s.
6115.001 (3g).
AB482,1,77 (b) "Private school " has the meaning given in s. 115.001 (3r).
AB482,1,88 (c) "Public school" has the meaning given in s. 115.01 (1).

1(2) Except as provided in sub. (3), an insurer may not do any of the following:
AB482,2,52 (a) Require or request directly or indirectly a policyholder or an applicant for
3insurance to reveal the grades of a minor pupil in a public school, private school or
4home-based private educational program who is a child or legal ward of the
5policyholder or applicant.
AB482,2,106 (b) Require or request directly or indirectly a policyholder or an applicant for
7insurance to provide permission to a public school, private school or home-based
8private educational program to disclose or make available to the insurer the grades
9of a minor pupil in the public school, private school or home-based private
10educational program who is a child or legal ward of the policyholder or applicant.
AB482,2,15 11(3) An insurer may require or request a policyholder or an applicant for
12insurance to reveal whether a minor pupil in a public school, private school or
13home-based private educational program who is a child or legal ward of the
14policyholder or applicant has at least a 3.0 grade point average, or the equivalent as
15determined by the school or program.
