AB487,1,3 1An Act to create 125.12 (2) (ag) 7., 125.12 (4) (ag) 9. and 125.33 (10) of the
2statutes; relating to: the source of a wholesaler's supply of fermented malt
3beverages purchased for resale.
Analysis by the Legislative Reference Bureau
Under current law, a wholesaler may purchase liquor for resale only from the
manufacturer, from the manufacturer's designated agent or from another
wholesaler. A wholesaler may not sell liquor acquired from any other source. A
liquor wholesaler that violates any law regulating the sale or purchase of alcohol
beverages may have its wholesale liquor permit revoked or suspended.
This bill requires a wholesaler to purchase fermented malt beverages for resale
only from the brewer, the brewer's designated agent or another wholesaler. A
wholesaler may not sell fermented malt beverages that have been acquired from any
other source. The issuing authority may revoke or suspend the permit or license to
sell alcohol beverages of a wholesaler who violates these restrictions and any person
who benefits from a violation.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB487,2,135 125.33 (10) Source of fermented malt beverages. No wholesaler may
6purchase fermented malt beverages for resale unless he or she purchases the
7fermented malt beverages from the brewer, from the exclusive agent designated by
8the brewer for the brand of fermented malt beverages sought to be sold or from a
9wholesaler licensed under s. 125.28. No wholesaler may sell fermented malt
10beverages purchased by the wholesaler to any other licensee or permittee under this
11chapter if the fermented malt beverages have not been purchased by the wholesaler
12from the brewer, from the exclusive agent designated by the brewer or from a
13wholesaler licensed under s. 125.28.
