AB522,1,2 1An Act to create 30.688 and 30.80 (5m) of the statutes; relating to: the use and
2possession of alcohol beverages on certain boats and providing a penalty.

Under current law, no person may drink in any motor vehicle while it is on a
public highway and no person may have a receptacle containing an alcohol beverage
in a privately owned vehicle if the bottle or receptacle has been opened. This bill
creates similar restrictions for the drinking and possession of alcohol beverages on
privately owned boats. The bill also provides an exemption from these restrictions
for passengers on charter boats or other boats hired to transport them.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB522, s. 1 3Section 1. 30.688 of the statutes is created to read:
AB522,1,5 430.688 Alcohol beverages in boats. (1) No person may drink alcohol
5beverages in any boat when the boat is being operated.
AB522,1,9 6(2) No person may possess on his or her person, in a privately owned boat, any
7bottle or receptacle containing an alcohol beverage if the bottle or receptacle has been
8opened, the seal has been broken or the contents of the bottle or receptacle have been
9partially removed.

1(3) The owner of a privately owned boat, or its operator if the owner is not on
2the boat, may not keep, or allow to be kept, in the boat any bottle or receptacle
3containing an alcohol beverage if the bottle or receptacle has been opened, the seal
4has been broken or the contents of the bottle or receptacle have been partially
5removed.
AB522,2,7 6(4) This section does not apply to passengers in a boat while the boat is being
7operated for hire or charter to transport those passengers.
AB522, s. 2 8Section 2. 30.80 (5m) of the statutes is created to read:
AB522,2,109 30.80 (5m) Any person violating s. 30.688 (1), (2) or (3) shall forfeit not more
10than $100.
