Under this bill, a reference in a will to another document that lists property
disposes of that property if the other document fulfills certain requirements.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB644, s. 1 3Section 1. 853.16 of the statutes is created to read:
AB644,1,9 4853.16 Effect of reference to another document. (1) A reference in a will
5executed on or after the effective date of this subsection .... [revisor inserts date], to
6another document that lists tangible personal property not otherwise specifically
7disposed of in the will disposes of that property if the other document describes the
8property and the distributees with reasonable certainty and is signed and dated by
9the decedent.
AB644,1,12 10(2) Another document under sub. (1) is valid even if it does not exist when the
11will is executed, even if it is changed after the will is executed and even if it has no
12significance except for its effect on the disposition of property by the will.
