AB673,1,5 1An Act to renumber and amend 343.135 (1) (a) 1.; to amend 343.135 (2) (a)
21.; and to create 343.135 (1) (a) 1m., 343.135 (3m) and 343.135 (5m) of the
3statutes; relating to: the minimum age for a special restricted operator's
4license for mopeds and motorized bicycles only and granting rule-making
5authority.
Analysis by the Legislative Reference Bureau
Under current law, the department of transportation (DOT) issues a special
restricted operator's license to any person who is at least 16 years old, or who is at
least 14 years old and physically disabled, and who satisfies certain testing and
application requirements. A person issued a special restricted operator's license may
operate on any highway in this state a motor bicycle or moped designed to operate
at a maximum speed not exceeding 30 miles per hour, or a specially designed vehicle
approved by DOT that is designed to operate at a maximum speed not exceeding 35
miles per hour. A special restricted operator's license is valid for not more than 2
years.
This bill lowers the minimum age for a special restricted operator's license to
operate only mopeds or motor bicycles from 16 years to 14 years old. The bill also
directs DOT to charge an applicant for this license a fee that approximates the cost
to DOT of processing the application and issuing the license if the applicant is
between the ages of 14 and 16 years old and is not physically disabled.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB673, s. 3 9Section 3. 343.135 (2) (a) 1. of the statutes is amended to read:

AB673, s. 4 11Section 4. 343.135 (3m) of the statutes is created to read:
AB673,2,1312 343.135 (3m) Age requirements. (a) For a special restricted operator's license
13to operate only vehicles described in sub. (2) (a) 1., at least 14 years of age.
AB673, s. 5 14Section 5. 343.135 (5m) of the statutes is created to read:
AB673,2,1915 343.135 (5m) Fees. The department shall charge an applicant for a special
16restricted operator's license to operate only vehicles described in s. 343.135 (2) (a) 1.
17a fee, established by rule, that approximates the cost to the department of processing
18the application and issuing or renewing the license if the applicant is under the age
19of 16 years and not physically disabled.
