AB729,1,3 1An Act to create 144.04 (3), 147.015 (21) and 147.016 of the statutes; relating
2to:
regulation of zero discharge wastewater treatment systems and granting
3rule-making authority.

This bill requires the department of natural resources (DNR) to regulate zero
discharge wastewater treatment systems to ensure the proper operation of those
systems. A zero discharge wastewater treatment system is a wastewater treatment
plant that is designed not to discharge any pollution into the waters of this state.
DNR may delegate the responsibility to regulate these systems to the public owner
of a sewage treatment plant. This bill also requires a person who proposes to
construct a zero discharge wastewater system to submit plans for the system to DNR
for its review and approval or disapproval.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB729, s. 1 4Section 1. 144.04 (3) of the statutes is created to read:
AB729,1,65 144.04 (3) For the purposes of this section, a zero discharge wastewater
6treatment system, as defined in s. 147.015 (21), is considered to be a system or plant.
AB729, s. 2 7Section 2. 147.015 (21) of the statutes is created to read:

1147.015 (21) "Zero discharge wastewater treatment system" means a
2treatment work that is designed not to discharge any pollutant into the waters of the
3state or into a publicly owned treatment works.
AB729, s. 3 4Section 3. 147.016 of the statutes is created to read:
AB729,2,13 5147.016 Regulation of zero discharge wastewater treatment systems.
6(1)
The department shall regulate zero discharge wastewater treatment systems to
7ensure the proper operation of zero discharge wastewater treatment systems. The
8department may delegate responsibility under this subsection to the owner of a
9publicly owned treatment works with a pretreatment program that has been
10approved by the department. The owner of a publicly owned treatment works to
11whom the department delegates responsibility under this subsection shall regulate
12zero discharge wastewater treatment systems in conformance with this section and
13rules promulgated under this section.
AB729,2,15 14(2) The department may promulgate rules for the regulation of zero discharge
15wastewater treatment systems.
