AB779,1,3 1An Act to renumber and amend 213.11 (2); to amend 213.11 (1), 213.11 (3) and
2213.11 (5); and to create 213.11 (2) (b) and (c) of the statutes; relating to: vari
3ous changes in the provisions regarding police relief associations.
Analysis by the Legislative Reference Bureau
Under current law, the purpose of a police relief association, which consists of
the members of the police department of a city, is to provide relief to the sick and dis
abled members of the association and their families. If a member at death leaves no
one entitled to relief under the constitution and bylaws of the association, the board
of trustees of the association may pay the expenses of the last illness and funeral
costs of the deceased member. A person who is a member of a police relief association
and who is no longer in the active employment of the police department due to retire
ment on a pension or annuity may still receive the benefits provided by the associa
tion as long as the person has served in the police department for at least 5 years.
Also under current law, the members of the board of trustees of a police relief associa
tion are to be elected annually.
This bill provides that the purpose of a police relief association is to provide
death benefits to the beneficiaries of members of the association. It also provides that
members no longer in the active employment of the police department who may con
tinue to receive the benefits of the association after at least 5 years' service in the
department include, in addition to those who are retired, those who are on a leave
of absence for a purpose that is specified in the bylaws of the association and those
who serve as a liaison between the police department and the city in which the police
department is located. The bill also provides that the members of the board of trust

ees of the association be elected for terms that are specified in the bylaws of the asso
ciation, rather than annually.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB779, s. 1 1Section 1. 213.11 (1) of the statutes is amended to read:
AB779,2,132 213.11 (1) The members of the paid police department in any city heretofore
3or hereafter organized, who comply with the constitution and bylaws of the associa
4tion hereinafter mentioned, are constituted a body corporate in such city under the
5name of "The Policemen Police Relief Association of the City of ....," for the purpose
6of giving relief to the sick and disabled providing death benefits to the beneficiaries
7of the
members of such association and their families and to such other persons as
8the constitution and bylaws of such association may provide. Provided, that where
9a member in good standing at the time of the member's death leaves no one entitled
10to relief under the constitution and bylaws of said association, such board is empow
11ered to pay the expenses of the last illness and funeral costs of said deceased member
,
12the amount to be paid hereunder in benefits to be limited to a sum to be fixed by the
13constitution and bylaws of said association.
AB779, s. 2 14Section 2. 213.11 (2) of the statutes is renumbered 213.11 (2) (intro.) and
15amended to read:

1ued for the good of the service; provided, that all persons becoming members of such
2policemen relief association on and after the first day of May, 1899, shall not be en
3titled to any of the advantages and benefits of such association from and after the
4time when they cease to be active members of such police department of any city
5aforesaid, unless such member
, and provided that the person ceases to be active in
6the active employment of the police department
by reason of having been any of the
7following:
AB779,3,8 8(a) The person is retired from active service on a pension or annuity.
AB779, s. 3 9Section 3. 213.11 (2) (b) and (c) of the statutes are created to read:
AB779,3,1110 213.11 (2) (b) The person is on a leave of absence for a purpose that is specified
11in the bylaws of the association.
AB779,3,1312 (c) The person serves as a liaison between the police department and the city
13in which the department is located.
AB779, s. 4 14Section 4. 213.11 (3) of the statutes is amended to read:
AB779,3,1915 213.11 (3) Each A person becoming who becomes a member of such police de
16partment after this section comes into force and effect in any city in this state shall,
17within one year after becoming a member of such department, be required to join
18such association and to pay an initiation fee not exceeding fifty dollars $50 and annu
19al dues so long as the person remains a member.
AB779, s. 5 20Section 5. 213.11 (5) of the statutes is amended to read:
AB779,4,1421 213.11 (5) The control and disposal of the funds, property and estate and the
22direction and management of all the concerns of such corporation, under such direc
23tion and restrictions as may be imposed by the bylaws thereof, shall be vested in a
24board of trustees to consist of a president, vice president, treasurer, secretary and
25executive committee of three 3, who shall be elected annually for such terms, at such

1time and place and by such members of the corporation as shall by the bylaws thereof
2be entitled to vote at such election
of the corporation may provide; and such officers
3so elected shall hold their respective offices for one year and until their successors
4are elected and qualified; and such corporation may elect or appoint such other offi
5cers and for such terms as its bylaws may prescribe. The officers of such corporation
6shall give bonds for the faithful performance of their respective duties when required
7so to do by the laws thereof. No person shall may be elected to or hold any office in
8such corporation unless that person be in the active employment of the police depart
9ment of the city to which this section becomes effective, and if that person's employ
10ment with such city shall be is terminated while holding the office of trustee or any
11other office of such corporation, that person's term of office shall thereupon be termi
12nated, and the members of such corporation as shall are, by the bylaws thereof, be
13entitled to vote, shall forthwith elect that person's successor in the manner pre
14scribed by the constitution and bylaws of the corporation
